Everything is OK, so you arrange to close the sale as soon as the title insurance company can issue you a policy. The title insurance company does a last-minute search to make sure there haven't been any changes, closes the sale, and issues you a <a href="http://www.artwoo.com/tag/title+insurance+policy" rel="tag">title insurance policy</a>. <br /><br /> 2. The title insurance company finds that the seller's title is fine, but alas =96 you are paying for the property with a bank loan, and the bank wants a <a href="http://www.artwoo.com/tag/mortgage" rel="tag">mortgage</a> on the property in exchange. So tell the closing agent to get you a title policy that makes an <a href="http://www.artwoo.com/tag/exception" rel="tag">exception</a> in its coverage for your mortgage. The bank, meanwhile, will issue the money only when it receives a title policy showing that it has a valid first mortgage on your property. Except for that mortgage, you're covered against any <a href="http://www.artwoo.com/tag/encumbrances" rel="tag">encumbrances</a> or other title defects on the property. <br /><br /> 3. Your title insurance company checks out the seller's title and discovers that it has a mortgage on it (probably taken out when the seller purchased the property). So make sure that the closing agent closes escrow only when the title insurance company issues a policy that does not list the owner's mortgage as an exception to its coverage. Of course they're not gonna do that until the mortgage is paid off, thus putting the ball in the owner's court. But you can smooth this one over by agreeing with the owner that part of your purchase money be paid to the holder of the mortgage in order to extinguish it. So what are the consequences of having an unmarketable title to your real estate? <br /><br /> 1. An unmarketable title can tank a sales transaction =96 it will allow the buyer to back out of a <a href="http://www.artwoo.com/tag/real+estate+purchase+contract" rel="tag">real estate purchase contract</a> even after he's already signed it. But the seller can cure any defects in the title right up to the point of closing =96 it's just that the buyer can refuse to close the sale until and unless any title defects are cleared up. If you miss the contractual <a href="http://www.artwoo.com/tag/closing+date" rel="tag">closing date</a> because of title defects, though, then the buyer may have the right to back out. In some states the buyer must give a seller holding unmarketable title early notice and a certain period to cure the title defect. But if you are a seller and don't live in one of those states, beware =96 if your <a href="http://www.artwoo.com/tag/real+estate+sale" rel="tag">real estate sale</a> contract with the buyer states that "time is of the essence", then you have until the contractual closing date and no later to cure all title defects necessary to make the tile marketable. <br /><br /> 2. If the title defect is minor (a claim against the title with only a remote chance of ever being enforced, for example), then the seller might be able to obtain a court order forcing the buyer to purchase the property, although the price of the real estate may be reduced to compensate for the title defect. <br /><br /> 3. If the buyer properly backs out of a <a href="http://www.artwoo.com/tag/real+estate+sales+contract" rel="tag"><a href="http://www.artwoo.com/tag/real+estate+sales" rel="tag">real estate sales</a> contract</a> because of the seller's failure to provide marketable title, then the buyer can sue the seller for the return of any down payment, and even "benefit of the bargain" damages in some states (the difference by which the market price for the property may have exceeded the contracted purchase price). <br /><br /> Unmarketable title is the buyer's <a href="http://www.artwoo.com/tag/bludgeon" rel="tag">bludgeon</a>, not the seller's. But of course it's not. The title insurance company is normally not going to check the title to the property all the way back to 1678 when the land was granted by the Spanish Crown =96 they're only gonna go so far back, maybe 60 years, and just take a chance that no jerk is going to come along and challenge your title based on a remote claim. Another loophole is that the law recognizes some legitimate claims over property cannot be recorded because they are not based on any written instrument such as a deed. Also, some states will not record certain documents such as short-term leases or sales contracts. Obviously there are many other factors that generate the overall ranking but optimising your title tags right will generally provide results for your <a href="http://www.artwoo.com/tag/targeted+search" rel="tag">targeted search</a> terms.<br><br>Target Individual Webpages Towards Search Terms<br><br>For <a href="http://www.artwoo.com/tag/search+engine+optimisation" rel="tag">search engine optimisation</a>, it is vitally important that your website has individual webpages with content targeted towards keywords and search terms. Each of these webpages should have their own unique title tag that includes the search terms you are hoping to be found for within search engines.<br><br>How People Search<br><br>Think about how you would type in a search into a search engine. It is unlikely you would type in a phrase such as "How You Should Optimise Title Tags". There is more of a chance that you may type "How Should I Optimise Title Tags", but people tend to shorten the total words needed to type a phrase as much as possible and will be more likely to type "How to Optimise Title Tags". Search engines would pick up the all above variations but by targeting the most popularly typed phrase you are increasing your chances of ranking better for that search term. So for example if your webpage had a title of "red widgets and blue widget" and another website's webpage had a title of "blue widget and red widgets", if you did a search for "blue widget" then the other website more likely to rank above your website (if all other factors are equal) simply because the search term is nearer the beginning of the title tag. A lot of companies put their brand terms first and then the page title, which is good if you are a recognised brand as it builds confidence and provides familiarity to potential visitors and may help encourage click from search listings, but it can be a slight disadvantage if you are looking to rank higher than a competitor who puts brand terms at the end of the title tag or left them out completely.<br><br>Another good reason to put the search term nearer to the beginning of your title tag is that search engines use the title to provide the link to your webpage in their listings. The title tag, is arguably THE most important on-page factor in SEO (and much more as you'll soon learn). <br /><br /> If you happen not to be too <a href="http://www.artwoo.com/tag/versed" rel="tag">versed</a> in <a href="http://www.artwoo.com/tag/html+coding" rel="tag">HTML coding</a> I'll explain what the title tag is. <br /><br /> The title tag is found within the and tags of a webpage. It's format is as follows: <br /><br /> Your Page Title Here <br /><br /> The title tag is important for two very simple reasons. <br /><br /> 1) The title of the page is given an enormous amount of weight by the <a href="http://www.artwoo.com/tag/search+engines" rel="tag">search engines</a>. It always has and it always will. It's of less importance today than it was 6 or 7 years ago, but it is still the most important on-the-page factor a page has. After all, it's sole purpose is to describe the page so it *should* be considered important. <br /><br /> 2) The title tag is also used as the <a href="http://www.artwoo.com/tag/anchor+text" rel="tag">anchor text</a> of your listing in the SERPs (<a href="http://www.artwoo.com/tag/search+engine+results" rel="tag">Search Engine Results</a> Pages). When someone visits a search engine and runs a search for one of your products, if one of your pages comes up in that search, it is the title tag that the visitor will see (along with a short description) and be able to click on to visit that page. <br /><br /> The problem is a LOT of webmaster's simply don't understand or make proper use of the title tag. Instead of name the page using keywords relevant to that specific page, they use their company name, etc. <br /><br /> Unless you are FORD, GE, or some other multi-million dollar company you should NEVER have your company name or website name (unless it's an SEO'ed website name) in the title tag. Are people going to be searching for your company or website name or are they going to be searching for keywords related to your product or service? <br /><br /> Let's look at a quick example from a real search I ran earlier today: <br /><br /> So a ran a search for "<a href="http://www.artwoo.com/tag/lawn+chairs" rel="tag">lawn chairs</a>" clicked to page number two and there sitting at #14 is a site with the title "Brookbend". <br /><br /> Now, this particular site actually has a LOT wrong with it, but for now we'll stick to the title tag, or lack-there-of as this particular site's title tag actually just said "Untitled Document". As a result, Google replaced that with the name from the URL which Google will often do when a webmaster does something stupid such as this. ;) <br /><br /> As I said, this particular listing was the 14th listing for "lawn chairs". That is actually VERY good considering it doesn't have a title tag. Imagine what it could have ranked if it had actually made use of the title tag? Possible using something along the lines of: <br /><br /> *Beautiful Outdoor Furniture, Lawn Chairs, Patio Tables* <br /><br /> Think they may have been able to achieve an even better rank? I would venture to say yes. <br /><br /> Now, there is also a second problem with their lack of a title tag and that is that their listing in the search engine is simply "Brookbend". I don't know about you, but if I'm looking for "lawn chairs" I'm probably not going to click on a listing that just says "Brookbend". For one reason, it doesn't contain either of the search terms I used in the title. For another thing, it isn't very "clickable". <br /><br /> You see, a title tag should do two things. It should incorporate that pages most important phrases and it should make someone want to click on it. You will notice in my above example, for the title I used "Beautiful Outdoor Furniture...". That is because, while I wanted the keywords in there, I also wanted it to read well and entice the surfer to click on it. This insurance is used to protect the lender against loss resulting from legal claims by others against your new home. In some states, lawyers will offer title insurance as a portion of their services in examining the home's title and providing a title opinion as to whether it is clear or not. The attorney's fee may include the title <a href="http://www.artwoo.com/tag/insurance+premium" rel="tag">insurance premium</a> or in some cases it may not. In other states, a <a href="http://www.artwoo.com/tag/title+insurance+company" rel="tag">title insurance company</a> or title agent directly provides the title insurance. <br /><br /> It is important for consumers to understand that the lender's <a href="http://www.artwoo.com/tag/title+insurance+policy" rel="tag">title insurance policy</a> does not protect the consumer. The same is true with the prior owner's policy; it does not protect you. When you need to protect yourself against claims by others against your new home, you will need what it is called an owner's policy. If you are buying a home which has changed hands within the last several years, ask your title company about a "reissue rate."
