But writing your own draft contract will cost you less than having a lawyer write it from scratch. <br /><br /> Here are some pointers: <br /><br /> 1.Avoid Legalese. It is usually best to write <a href="http://www.artwoo.com/tag/contracts" rel="tag">contracts</a> in a language called "English". Contracts do have to be precise, however. Write your contract with an imaginary demon sitting on your shoulder trying to twist your language around to make it mean something else. There is often a big difference between the date given verbally in the showroom (for example, two years from now or December 2008) and what you <a href="http://www.artwoo.com/tag/subsequently" rel="tag">subsequently</a> find in the contract presented for signature (18 months from when building begins, for example, or two years from the issue of the building license). You, the purchaser, clearly have no control over the building license, or when construction commences. You have no alternative but to wait! <br /><br /> Another example of an abusive clause is one that gives the developer the right to make changes to the property being purchased subsequent to the sale being agreed. On completion, however, there is no bath in the bathroom, but a shower instead. Unless you want to convince a Spanish judge that your property has suffered a loss in value as a result, you will have no option but to accept the property as it is / with a shower instead of a bath. <br /><br /> There are many other abusive clauses. What they all have in common, however, is the circumvention of the consumers' legitimate rights. <br /><br /> The Spanish <a href="http://www.artwoo.com/tag/consumers+association" rel="tag">Consumers Association</a> (la confederacion de Consumidores y Usuarios - <a href="http://www.artwoo.com/tag/cecu" rel="tag">CECU</a>) recently studied a sample of property purchase contracts. But often it is simply a device to try and get round the constraints of <a href="http://www.artwoo.com/tag/employment+legislation" rel="tag">employment legislation</a>, in the hope of keeping flexibility in an uncertain future -- in essence, shifting the risk of <a href="http://www.artwoo.com/tag/job+security" rel="tag">job security</a> from the firm to the individual. Of course, European legislation has recently made this more difficult. But there is a bigger question underlying the practice: whether using temporary contracts improves or harms an organisation's performance. <br /><br /> In general, the popular assumption has been that people will <a href="http://www.artwoo.com/tag/work+harder" rel="tag">work harder</a> if they have to get their contract renewed in a few months, and that that will improve output. On the other hand, it is argued that people on temporary contracts may be more dissatisfied and so perform less well. Psychologists in this area have performed useful studies over recent years, though the results have not always been what one would expect. <br /><br /> Mark O'Sullivan of Birkbeck tested the question in a small but representative study of UK <a href="http://www.artwoo.com/tag/public+sector+employers" rel="tag">public sector employers</a>, by looking at expectations of staff performance (through scores in the recruitment process) against how they actually performed (through staff appraisal scores), and seeing whether this comparison was different for those on temporary contracts. The results depended on how employable staff felt. Professionals who expected easily to be able to find another job resented being put on temporary contracts and performed less well. But less skilled or mobile staff in areas with fewer vacancies did work harder and produced more. <br /><br /> A subsequent major survey-based study is now under way across a number of European countries, led by David Guest of <a href="http://www.artwoo.com/tag/kings+college+london" rel="tag">Kings College London</a>. Initial results suggest that staff often now prefer to be on temporary contracts -- but that the reason is that it is a way of avoiding the more difficult or less visible work: this gets given to the permanent staff, who also have to put up with the long hours needed to deliver it, while their temp colleagues are already down the pub. The effect on organisational performance has not yet been measured, but seems unlikely to be positive. <br /><br /> We can conclude that the true position is complex, and that no one should offer temporary contracts without a good deal of thought: motivational effects on both the temporary employees and on their permanent colleagues may be hard to predict. If you are a buyer, get clear and complete representations from the seller =96 and if you are a seller, don't make any <a href="http://www.artwoo.com/tag/false+representations" rel="tag">false representations</a> to the buyer. <br /><br /> <a href="http://www.artwoo.com/tag/consumer+protection+laws" rel="tag">Consumer protection laws</a> will, in effect, write invisible representations into <a href="http://www.artwoo.com/tag/consumer+contracts" rel="tag">consumer contracts</a> even if they are not written down. An electric razor that won't shave, or a DVD player that won't play DVDs may be returned for a full refund even if the contract did not say that the product would actually work. <br /><br /> In a commercial contract between two businesses where the purchase terms are negotiated rather than being offered on a "take it or leave it" basis (known as an "adhesion contract"), consumer protection laws will not apply. The mini-<a href="http://www.artwoo.com/tag/futures+contracts" rel="tag">futures contracts</a> were designed to fill the gap that exist between the high roller large accounts and those that only have a couple of thousand dollars to invest. <br /><br /> New traders are told to stay away from mini-futures because there is not enough contracts traded and you can lose all your money. That statement is true, and applies to trading standard <a href="http://www.artwoo.com/tag/commodity+contract" rel="tag">commodity contract</a> as well, if you plunge right in without first learning your craft. <br /><br /> Mini futures provide excellent trading opportunities for the small trading accounts. <br /><br /> It does not take a trading genius to make money trading mini commodities, just a little common sense and patience. There is nothing mystical about <a href="http://www.artwoo.com/tag/trading+commodities" rel="tag">trading commodities</a> nor are there any great secrets to trading. <br /><br /> Standard and mini futures <a href="http://www.artwoo.com/tag/contract+charts" rel="tag">contract charts</a> look all most identical. <br /><br /> The major difference is the volume of contracts traded is much less that that of a standard futures contract. It should be noted that standard size contract charts can be used to find trades for the Mini Futures market simply because the mini-futures, for all practical purposes, mirror the standard size contracts. <br /><br /> Currently there are four groups of futures contracts that trade the mini contracts. <br /><br /> AAgriculture. Long term trading <br /><br /> 1. Wheat  2. Corn  3. Soybeans <br /><br /> BCurrencies. Extremely risky <br /><br /> 1. Euro FX mini  2. Japanese Yen mini <br /><br /> CPrecious metals. Extremely risky <br /><br /> 1. NY Gold mini  2. NY Silver mini <br /><br /> DIndexes. Extremely risky <br /><br /> 1. Nasdaq 100  2. Russell 2000 emini  3. SandP 500 emini <br /><br /> A new trader should stick to the first category to learn the proper way to trade commodities. There is still a risk in the corn, wheat, and <a href="http://www.artwoo.com/tag/soybean+markets" rel="tag">soybean markets</a> but it is reduced a great deal with the mini contracts. The other three categories do have mini contracts. However, they can be extremely volatile and wipe out a trading account in a heart beat. <br /><br /> Trading mini futures contracts can give new traders a chance to gain experience while building confidence and cash in on the fabulous profits being made in the futures markets. It does not take a small fortune to learn how to trade commodities. <br /><br /> Current margin (performance bond) required for a mini wheat contract is $400. One point (Cent) on a mini soybean contract = $10. With proper money management a new trader can slowly build their trading account and at the same time learn the craft of futures trading. <br /><br /> There are fortunes being made by commodity traders (speculators) every year. The best part about being a commodity trader is it does not matter if the markets are going up or down. You can make money even if the economy is in a recession. <br /><br /> Over night fortunes are very rare to non-existent in commodity trading. <br /><br /> However, you must understand perfect trades do not happen every day and it will take some experience to spot them. Mr. Larry Williams, a recognized trading professionals, made the statement "You don't have to take every trade; just the winning ones." Patience is one of the key ingredients of successful trading. <br /><br /> It's tough sitting on your hands and not jumping on every trade but it pays off in the long run. <br /><br /> Always remember. Commodity trading is an extremely risky business. The first rule of a successful commodity trader is Plan Your Trade!
