These situations occur when 401k participants fail to select an investment option for their 401k contributions or a 401k default fund is used in 401k plans with automatic enrollment features.

Currently, 401k plan sponsors are rethinking their default fund decisions because they are concerned about the risk associated with their fiduciary responsibility and about the risk of the earnings performance of the default investments of those participants who failed to choose any.

When a participant fails to make a choice, the default fund is the choice made for them by the plan's fiduciaries. And because the participant is NOT making the decision when a default investment is used, the plan fiduciaries are responsible to prudently invest their funds.

Many plan sponsors feel that their decision on the default investment is protected by the safe harbor exemption of Internal Revenue Code Section 404c. Section 404c provides an exemption to plan sponsors from liability for investment decisions when participants are given the choice to choose their own investments. Section 404c transfers liability to plan participants for their choices of investment options. Here, sponsors believe that by not making an active choice, the participant has decided to take the default investment.

And if the default investment is a Stable Value or Money Market Fund, the participant does not loose any of his principal. Plan sponsors feel that the participant's funds are not at risk and so neither are they.

Because the participant is not making the decision when a default investment is used, there is no 404c defense for plan fiduciaries. Also, sponsors are required by ERISA to invest with a reasoned, thoughtful process for evaluating risk and returns and for providing investment options that are diversified and prudent.

Under the forthcoming guidance -- which, said a Dept of Labor law specialist in the Office of Regulations and Interpretations, is subject to change -- 401k fiduciaries are given a safe harbor on 401k investment management decisions and any breach that is "the direct and necessary result of investing a participant or beneficiary's account" in a default investment. Investment managers and advisers, on the other hand, are solely responsible for any decisions they make with regard to the 401k investments or any resulting losses and do not get that kind of relief.

In order to qualify for that 401k safe harbor, however, 401k fiduciaries must allow participants:

- the opportunity to move their investments into an alternate account - provide advance notice of the default investment and - invest the assets in a certain kind of qualified default investment.

Moreover, that choice, which can be a lifecycle fund or a managed account, among others, must limit the presence of employer stock in the portfolio, as well as allow funds to be transferred out of the default.

The 401k fiduciary responsibility associated with selecting funds for the default investment options in a 401k plan has now been tempered with this new preliminary safe harbor.

Though studies have been performed and have come up with some results, due to the high number of variables, the impact that climate has as a gout cause is by no means well understood. Therefore, the studies have looked into geographical distribution with regards to the number of cases of gout as a weak guide regarding the weather that is most likely to bring about the disease.

Results showed that flare-ups of gout were most common during hot and humid weather. This being said, these same scientists reported that drinking a lot of water was a notable preventative for gout attacks during these hot, humid periods.

The research was performed in 2006 by Boston researchers (and presented at the 2006 American College of Rheumatology's annual scientific meeting) who studied 197 participants who had gout, and examined the influence of temperature and humidity on the frequency of the condition. When the participants experienced a gout attack, they completed a two-day control questionnaire.

Further data was obtained through the collection of the ZIP code of the participants and the federal climate data from those regions so that they would know when the participants were in risk periods, and when they were in control periods. Adjustments were made when additional gout cause risk factors were present, such as the consumption of meat, alcohol, or diuretics.

These scientists noted that humid, hot temperatures brought about a significantly increased number of gout attacks in the participants. However, in terms of barometric pressure and precipitation, no gout cause association was found.

It was suggested by the researchers that in order to prevent flare-ups of their gout, it was very important that they avoid dehydration by drinking additional fluids during times of hot and humid weather.

Gout levels in the United States have doubled throughout the last few decades. This increase in gout attacks mirrors the increase in fructose consumption through soft drinks and other sugary foods. Fructose is a simple form of sugar that is now known to increase the production of uric acid in the body.

Though patients who suffer gout attacks are typically instructed by their doctors to cut alcohol, organ meats, and legumes from their diets, as they are high in purines -- organic compounds that encourage uric acid production in the body -- it is rare for patients to be told to limit their consumption of fructose-filled foods such as soft drinks.

American and Canadian researchers examined the relationship between the intake of high-fructose foods such as soft drinks and the risk of a gout attack. They looked into more than 46,000 men who had no history of gout attacks, and who were aged 40 or older. They followed these men for 12 years, compiling data on food consumption regarding more than 130 different beverages and foods including both regular and diet soft drinks, as well as fruits and fruit juices which are also naturally quite high in their fructose levels. From the start of the study, the researchers collected weight, medication use, and medical condition data. During that time, there were 755 new cases of gout attacks diagnosed within the participants.

The major findings of the study included the following:

- The more sugar-sweetened soft drinks were consumed by the participants, the higher their risks of a gout attack would be.

- When men who drank fewer than one serving of soft drinks in a month were compared to participants who drank over five or six servings every week, the risk of a gout attack was increased by 29 percent.

- The participants who drank two or more servings of soft drinks daily increased their risk of a gout attack by a significant 85 percent when compared to those who consumed fewer than one serving of soft drinks every month.

- Participants who consumed only soft drinks did not increase their risk of a gout attack.

- Fructose-rich foods such as fruits and their juices also increased the risk of a gout attack. However, the study's authors caution that the interpretation of the impact of fruits and fruit juices on the risk of gout should be interpreted with care as eating some fruits and vegetables is important for the prevention of high blood pressure, stroke, heart disease, and some cancers, and should therefore perhaps be considered more beneficial than hazardous.

2. Within the group with strong guarantees, look for one with a low refund rate under their guarantee. Low refund rates mean happy clients that used their list to get paid to fill out surveys, made money and were satisfied.

High refund rates mean unhappy clients that used the site's list to get paid to fill out surveys, did NOT make money, were dissatisfied and demanded their money back.

So pick a paid survey membership site with a low (3-6%) refund rate, avoiding any with refund rates as high as 9-10% or more.

Sign up with that low-refund-rate site, get a copy of their list and then sign up with all of the survey makers on their list. The more you sign up with the more surveys you will be offered and the more money you will make.

You will have then positioned yourself to join the happy clients of a good paid survey site with a good list. You should make enough on the first 2-3 surveys to repay your membership fee. From there on you just get paid to fill out surveys and make money.

The only way to lose is to get the list and NOT sign up with all the survey makers on it. Survey makers compete with each other; they don't share lists of participants. You have to sign up with each one separately.
