    <content:encoded><![CDATA[ Part 36 Offers - Payment Into Court. <br /><br /> If you are involved in <a href="http://www.artwoo.com/tag/civil+litigation" rel="tag">civil litigation</a> with a party and is locked into dispute over the value of a claim, for example a <a href="http://www.artwoo.com/tag/personal+injury+claim" rel="tag">personal injury claim</a>, you can make what is known as a Part 36 offer to that other party in the dispute. <br /><br /> It is a tactical measure which is frequently used by <a href="http://www.artwoo.com/tag/personal+injury+lawyers" rel="tag">personal injury lawyers</a> to resolve disputes over quantum or the value of a claim. If used effectively it can bring the other party in the action to his knees due to the effect it has on cost. <br /><br /> If therefore you are ever involved in a dispute over money as in the case of <a href="http://www.artwoo.com/tag/personal+injury+compensation" rel="tag">personal injury compensation</a> and the other party makes a 'Part 36 Offer' you or your solicitor needs to take this very seriously indeed. <br /><br /> What is a part 36 offer? <br /><br /> So what exactly is a Part 36 Offer? I explain this in some depth in my book `The Personal Injury Claims Guide for DIY Claimants' which also provides other tactics in personal injury claims negotiations. <br /><br /> Basically, a Part 36 offer is made pursuant to Part 36 of the <a href="http://www.artwoo.com/tag/civil+procedure+rules" rel="tag">Civil Procedure Rules</a> which were brought into effect in 1998 under Lord Justice Woolf. <br /><br /> Part 36 Payments to County Courts and High Court . <br /><br /> Previously, the procedure existed but was known as a `Payment Into Court' under which a physical payment was made to the court following the <a href="http://www.artwoo.com/tag/offer+letter" rel="tag">offer letter</a>. If proceedings were in one of the County courts then the payment was made to that particular court. <br /><br /> If the claim was of a higher value than the county <a href="http://www.artwoo.com/tag/court+limits" rel="tag">court limits</a> or it was a case involving complex issues as dealt with in the High Court then payments were made to the Accountant General of the Supreme Court. <br /><br /> More recently you do not need to make a physical payment into court and a suitably drawn Part 36 offer letter is sufficient for these purposes. <br /><br /> The Part 36 offer must be sufficiently detailed to enable the other party to see how the offer is made up. You cannot just state an amount in your offer letter and expect the other party to accept it without stating how you arrive at the offer made. <br /><br /> The offer would not be effective in these circumstances and you would lose the main benefit of a Part 36 offer which is to protect you in respect of costs. <br /><br /> Costs. <br /><br /> Once an effective Part 36 offer has been made the other party in the negotiation has 21 days to respond to the offer. He is not bound to accept your offer and may very well decline your offer and counter-offer with his own Part 36 offer. <br /><br /> If agreement cannot be reached the offers stay on record until the trial of the case.During this time the judge is not made aware of the offers as this would prejudice his decision at trial when awarding compensation otherwise known as damages. <br /><br /> If these offers were to be revealed to him he could favour one or either of the parties and make an award to benefit that party. <br /><br /> Judgment award. <br /><br /> Once the judgment amount is known if this lower than the Part 36 offer by even a penny then the other party must pay all his own costs and those of the party making the Part 36 offer. These costs include the full trial costs and all costs incurred from the date the Part 36 offer was made. <br /><br /> The burden of costs is therefore extremely high for the losing party who fails to beat a Part 36 offer. When you understand different categories, you will understand what company is best for your success. So far we have discussed: category 1 - "old guys"<br><br>Category 2 - "The Plans"<br><br>There are many companies which fall into this category; many party plans, phone and utility services, legal and insurance plans, <a href="http://www.artwoo.com/tag/discount+cards" rel="tag">discount cards</a> and services, air and water purifiers, and other plans that are really for salespeople.<br><br>The key part of this is the "salespeople" aspect. There is a huge difference between the small business model and the big business model in network marketing. The "plans" are primary a small business model as you are really retailing products. The big business model is developing a large team of distributors that ends up developing large volumes because of the size of the group. The small business model requires ongoing work to maintain an income. The big business model will eventually create the sought after "<a href="http://www.artwoo.com/tag/passive+income" rel="tag">passive income</a>".<br><br>When you break down 'retailing products' you end up being a sales person. This is great for those who are the sales <a href="http://www.artwoo.com/tag/person+types" rel="tag"><a href="http://www.artwoo.com/tag/person+type" rel="tag">person type</a>s</a>. This type of person does not have a <a href="http://www.artwoo.com/tag/fear+of+rejection" rel="tag">fear of rejection</a> and has, or can develop, selling skills. However, most of the population is not the sales-person type. They don't want to sell and do not like rejection.<br><br>As a result, many people do not do well with the "plan" companies. They may join the company after a positive <a href="http://www.artwoo.com/tag/product+experience" rel="tag">product experience</a>, but soon are dropping out because they end up doing with they don't like to do..and that is selling and the rejection that will come with it.<br><br>A large income can be achieved for the salesperson, but it is based on constantly replacing those who drop out because they are not salespeople. This does not create duplication, and therefore will not create a passive income. Passive income is created by "doing the work once and getting paid for it forever". An example of passive income is buying an insurance policy; the insurance agent will get paid monthly as long as you keep that policy. They will claim that they are not a pyramidal system, which is illegal, but they are for the most part. They will guarantee you a certain level of income with a specific number of team members. They will give you a "reasonable" time period for which this can all be accomplished. Basically what they are doing is feeding you a lot of bull about their "once in a lifetime" part time jobs. <br /><br /> Now I want to make it very clear that this is the vast majority, which means that there are legitimate chances to make a decent income while at home and on your own schedule but you must be ready to work hard and you have to be good at what ever you do. My answer is always the same -- "Absolutely!" <br /><br /> Somehow people have been convinced that you have to spend hour upon hour in front of computer watching the markets in order to have a chance at success. That is simply just not true. Part-time trading can be extremely worthwhile -- in some cases even more so than trading more actively. I am proof of that. Even though I sometimes do have the opportunity to trade more frequently, my best trades always seem to be the ones I do on a more part-time basis -- the ones that only require an <a href="http://www.artwoo.com/tag/occasional+check" rel="tag">occasional check</a> of the markets. <br /><br /> This may sound strange coming from someone who used to be a <a href="http://www.artwoo.com/tag/professional+analyst" rel="tag">professional analyst</a> and really does enjoy the markets, but I really have no desire to spend all day in front of the trading screens. It's a grind, and I have a <a href="http://www.artwoo.com/tag/lot" rel="tag">lot</a> of other things I enjoy doing a whole lot more than watching <a href="http://www.artwoo.com/tag/price+quotes" rel="tag">price quotes</a> tick up and down. I'm sure you could say the same. <br /><br /> Effective part-time trading is simply a matter of maximizing the time you have available. That might be an hour a night, or maybe a couple hours on the weekend. Maybe it's even less than that. It doesn't matter. If you make the most of what you have, you can do good things trading part-time. Doing so is a matter of developing a method for your work and applying it consistently. <br /><br /> I'll use myself as an example. <br /><br /> My schedule is somewhat convoluted. I travel frequently and my activities have a <a href="http://www.artwoo.com/tag/seasonal+nature" rel="tag">seasonal nature</a> to them. There are points in the year when I have almost no time to devote to the markets. At other times I can maybe put in an hour each morning. Then there are also times when things are more open and I can be a bit more active. <br /><br /> Regardless of my time availability, though, I always do the same thing. I scan the charts for the markets I'm interested in trading and look for something specific. If I don't see it, I move on to the next. If I don't see anything good, I don't trade. It's as simple as that. <br /><br /> My available trading time will dictate which timeframe charts I look at when doing my scan. If I'm at a point where I can be more active, I'll perhaps look at the hourly charts. If I can only check in on things once or twice a week, I'll look to the daily and/or weekly charts to find possible trades with longer holding periods. In that way, I can choose the best timeframe for me to operate in for my schedule at that point. <br /><br /> What is more, I don't ever have to trade. That's a major advantage for part-time traders. Unlike our full-time peers who are under pressure to produce results every day, we can pick our spots and only go after trades likely to be big winners. I'll take that relaxed approach any day! <br /><br /> Let's face it. Full-time trading is a commitment most of us will either never be able to or never be willing to make. That doesn't mean we cannot make excellent use of the markets to better our financial situation.
