The growth in property prices over the last ten years has resulted in a rise in the number of people choosing to build their own homes and that, together with ongoing residential developments, means that land is becoming more scarce.     <content:encoded><![CDATA[ As we start to move into the last few weeks of 2007, it's natural to look ahead to what might happen in 2008. <br /><br /> Often future predictions are made off the back of what's happened over the last <a href="http://www.artwoo.com/tag/12+months" rel="tag">12 months</a>. And it's been a very busy year for the UK property market. <br /><br /> There have been numerous changes and predictions for the future. We take a look at what's happened so far in 2007, and how that could affect the market next year. <br /><br /> First off the big <a href="http://www.artwoo.com/tag/issue+that+affects" rel="tag">issue that affects</a> all of us - house prices. <br /><br /> UK property prices have had an interesting year. Some organisations have reported prices going down; others have claimed they have gone up in some areas. Overall it seems likely there has been at the very least a <a href="http://www.artwoo.com/tag/slowdown" rel="tag">slowdown</a> in the growth of prices. <br /><br /> The current average price for a UK property is =A3225,826. And the <a href="http://www.artwoo.com/tag/nationwide+building+society" rel="tag">Nationwide building society</a> says in 2007 the annual price growth was 9.7 per cent. <br /><br /> But a new report it has just released has predicted zero per cent house price growth in 2008. <br /><br /> It says UK property prices will stay exactly as they are now. This means in real terms that the value of homes will fall, as the cost of living continues to rise. <br /><br /> The building society blames this potential 'freeze' on a slowdown in the wider economy. It points out that price growth was supported in 2007 by the strength of the British economy, especially in the financial and manufacturing sectors. <br /><br /> But over the next 12 months it expects economic growth to slow from three to two per cent. And when that is combined with lower <a href="http://www.artwoo.com/tag/disposable+incomes" rel="tag">disposable incomes</a> caused by the cost of petrol and other rising bills, plus <a href="http://www.artwoo.com/tag/high+interest+rates" rel="tag">high interest rates</a> and tighter lending conditions, it's likely to slow the economy. <br /><br /> The Nationwide also believes there will be a fall in demand in buy to let houses, affecting UK property. <br /><br /> Of course, the likelihood is that any slowdown in price growth is going to be short-term only. Many <a href="http://www.artwoo.com/tag/experts+agree+that" rel="tag">experts agree that</a> the long-term prospects for property value growth remain good. So it's only something to worry about if you are considering selling property in the next 18 months or so. <br /><br /> Let's take a closer look at one of the factors affecting prices - interest rates. <br /><br /> Since August last year, rates have gone up five times. But they have stayed the same for the last three months, and many people believe they will drop before the end of the year. <br /><br /> If the economy does see a slowdown as predicted, it's likely that interest rates will go down again in 2008. This is good news, as it will ease some of the financial pressures squeezing people and give them a little more disposable income. This is likely to give the economy a small boost, which may in turn be good for UK property. <br /><br /> The other major factor to look at for 2008 was a huge source of controversy in 2007. <br /><br /> Home Information Packs, or HIPs, were first introduced for four bedroomed houses on 1st August this year, and extended to three bedroomed properties on 10th September. <br /><br /> A survey by the Royal Institution of Chartered Surveyors in September revealed that that the number of properties needing a HIP coming onto the market continued to fall, when compared to the same month in 2006. <br /><br /> And 73 per cent of surveyors who responded to the survey saw a decrease in three bedroom or larger properties coming onto the market. <br /><br /> Experts predict that the effect of HIPs will lessen in 2008. They believe people will get used to the idea of needing to compile a document before they can put their UK property up for sale. And in time that will mean the HIPs have very little real effect on the market. Let's start by looking at what we consider to be a society. <br /><br /> In our daily lives, a society is the place where we live. It is made up of the government, the <a href="http://www.artwoo.com/tag/education+system" rel="tag">education system</a>, the health care and the many occupations that people have. Each and every person is an important part of a society because each one has something to contribute. It is a very broad concept that is often broken down into different segments or facets of life. Within a society, there are smaller societies or <a href="http://www.artwoo.com/tag/groups+of+people" rel="tag">groups of people</a> who have a particular goal or ambition. These could be <a href="http://www.artwoo.com/tag/government+agencies" rel="tag">government agencies</a>, groups of students or groups raising money for a cause. <br /><br /> There are also other factors that separate smaller societies from one another. These include culture, language, race, and religion. Within a society, there can be many different cultures. If you look at the whole world as one society, you can easily realize just how many differences there are. Even within a country, city or town, you have numerous differences and you can even have different societies within a neighborhood. Nationwide calling plans have the highest per minute rate with regional calling plans in the middle. Many larger networks are dropping local calling areas in favor of regional and nationwide calling plans. When choosing a calling plan it's important to consider how much traveling you will be doing and how much time you will spend outside of what is considered your regional calling area. Many organizations have lots of guidelines and rules to follow. This is not what the Red Hat Society is all about.<br /><br /><br /><br /> This group is mostly about <a href="http://www.artwoo.com/tag/women+over+50" rel="tag">women over 50</a> <a href="http://www.artwoo.com/tag/having+a+great+time" rel="tag">having a great time</a> and making new friendships. The chapters are open to all women and there is no discrimination allowed. Instead of wearing a red hat and purple clothing, those under 50 wear pink hats and lavender attire. <br /><br /> The Red Hat Society was begun by a woman named Sue Ellen Cooper. Sue Ellen and a few of her friends got the idea from a poem entitled, "Warning" which mentions wearing a red hat and purple clothing while growing old. The group has evolved into an organization that has over one million members worldwide.  The Red Hat Society was established in 1998. <br /><br /> You can join an existing group or start a chapter in your area.<br /><br />All of the membership information is available online and it is easy to join or begin a new chapter. If you are looking for an existing chapter in your area you will be able to find out all about it on the website. <br /><br /> A regular membership is a possibility and this allows for activities, fun and partial access to the Red Hat Society online community. So many groups cater to <a href="http://www.artwoo.com/tag/younger+women" rel="tag">younger women</a> but this is a group that applauds and celebrates those of us who are 50 or older. <br /><br /> The Red Hat <a href="http://www.artwoo.com/tag/society+functions" rel="tag">Society functions</a> as an organization that brings older women together. There are all kinds of things that members of this group can do and it is up to each chapter to organize and plan their activities. <br /><br /> Everyone is welcome in the Red Hat Society, backgrounds do not matter. A red had is needed and the flashier and more luxurious, the better. There are also many other accessories and pieces of clothing that members may choose to wear. <br /><br /> The Red Hat Society has been around since 1998 and the reason it was started was to build community and friendships among women who are 50 years of age or older. This is a group that is not about social issues or <a href="http://www.artwoo.com/tag/raising+money" rel="tag">raising money</a>. The members of the Red Hat Society are not on a mission to save the world. Certainly, not all puppies that are bought and sold in pet stores originated from a puppy mill; however, it is shocking to hear the truth of these horrific mass dog breeding houses. These dogs are bred and raised with sometimes up to hundreds of other dogs at a time. This is a serious health hazard for these <a href="http://www.artwoo.com/tag/newborn+puppies" rel="tag">newborn puppies</a>, because their cages are often filthy and <a href="http://www.artwoo.com/tag/unkempt" rel="tag">unkempt</a>. Living conditions such as these practically beg for disease and viruses to enter and grow in the puppies' bodies, wrecking havoc on their health and immune systems. Many puppy mill pets are not neutered or spayed, neither they given the proper vaccinations and preventative medications that are necessary for their health and well-being. <br /><br /> The majority of puppies who are bred in puppy mills are actually sold online or through newspaper advertisements, though some do appear in pet stores nationwide. Many of these puppy mills claim to sell "pure bred" dogs, but this is not always the case. Dogs are affectionate and companionable animals; when they are denied daily affection and interaction with adults and children, they suffer emotionally and mentally. <br /><br /> So, what can you do to help? Also, when you want to buy a new pet, adoption is a wonderful alternative. You will receive a healthy, happy pet, who has most likely already been housebroken, neutered or spayed, and vaccinated; the best part is, you will not be supporting puppy mills through your personal purchase of a puppy from a pet store. <br /><br /> Of course, there are more active ways you can help. The Humane Society asks people to diligently spread the word about the harsh realities of puppy mills, inform their friends of the Stop Puppy Mills website (listed above) as well as making a monetary donation to the Humane Society. It is easy to make a donation online, and it only takes a few minutes of your time if you feel compelled to give. There is also a page that gives interested people additional ideas for helping them stop puppy mills, such as lobbying for new laws that will aid in the shutting down of these mills.     <content:encoded><![CDATA[With more than 6,000 different <a href="http://www.artwoo.com/tag/mortgages" rel="tag">mortgages</a> on offer from around 130 lenders you could be forgiven for giving up and just accepting the first offer you get. <br /><br /> But it pays to research when taking out a mortgage and that basic advice applies whether you are a first-time buyer starting out on the property ladder or whether you already have a mortgage and are looking for a new deal. <br /><br /> On a £100,000 mortgage you can save up to £1,300 a year by picking the best-value mortgage compared with the most expensive. That's a handy £108 a month in your pocket. <br /><br /> However it's not the case that all deals are open to all customers. <br /><br /> <a href="http://www.artwoo.com/tag/nationwide+building+society" rel="tag">Nationwide Building Society</a> has recently ended its long-standing policy of offering the same deals to all customers. Previously it didn't matter whether you were a first-time buyer, an existing customer looking for a lower rate or someone looking to move your mortgage to Nationwide. So what does this mean for you? <br /><br /> All customers are not the same so all deals are not the same <br /><br /> <a href="http://www.artwoo.com/tag/mortgage+companies" rel="tag">Mortgage companies</a> will offer you different deals depending on what sort of customer you are. The basic rule is that they like <a href="http://www.artwoo.com/tag/new+business" rel="tag">new business</a> as that is the way they build up their customer base. <br /><br /> So if you are a first-time buyer you will qualify for better deals. Nationwide, for instance, offers deals worth around 0.1 per cent cheaper to new customers than it does to existing customers. That might not sound like a lot but on a £100,000 loan it can be worth around £100 a year. <br /><br /> Many lenders offer better special deals to first-time buyers and similar deals are on offer to people moving their mortgages from another lender. <br /><br /> Surely loyalty pays though <br /><br /> Staying with the same lender for the term of your mortgage - and that can be as long as 25 or even 40 years - ought to make you popular with your company. Well up to a point. <br /><br /> <a href="http://www.artwoo.com/tag/mortgage+lenders" rel="tag">Mortgage lenders</a> always want new business so they offer deals to people remortgaging to them from another lender. That means they've taken business off a rival so they're willing to offer slightly better deals. Again the difference can be around 0.1 per cent or even 0.25 per cent. <br /><br /> If you are coming to the end of a fixed-rate deal then it can make sense to switch to another lender. They'll offer you a better deal than they're offering their existing customers and will welcome you with open arms. <br /><br /> Should I stay or should I go? <br /><br /> Whilst lenders offer different deals to existing customers than they do to new customers, that does not mean they won't be willing to offer a deal to you if you are planning to change to another firm. <br /><br /> You should always talk to your existing lender if you are planning to move mortgage. They may not make you an acceptable offer but it does not hurt to ask as you could be surprised how much they want to keep your business. <br /><br /> Bear in mind that there may be costs involved in moving your mortgage from one firm to another. <br /><br /> Companies will sometimes charge application fees which on average are around £634. You may also get stung from your existing lender in the form of an exit fee for leaving them and going elsewhere. Exit fees can be as much as £202 among the main lenders. <br /><br /> Some mortgages - particularly fixed-rate and discount deals - lock you in once the term of the deal ends. Check the terms of your existing deal for any redemption penalties and whether you can move without any penalty at the end of term. Redemption penalties are generally a percentage of the amount borrowed so it you have a £100,000 loan and have to pay a one per cent fee you will be charged £1,000. <br /><br /> Even if you only have to pay an application fee and an exit fee any savings you make by moving to a lower rate may be wiped out. If you are saving £100 a month on your mortgage it does not make sense to spend heavily on fees. Before you make the move calculate how much you will save and take into account any fees. <br /><br /> Remortgaging makes sense <br /><br /> Cutting down your monthly payments and keeping them as low as possible is the best approach to managing your mortgage. You wouldn't throw away money in any other part of your life so don't do it with your mortgage. <br /><br /> Whether you are a first-time buyer, an existing customer or someone looking to move mortgage from another lender you should always keep an eye out for better deals. That means reviewing how much you are paying every year and it should mean keeping an eye on the rates being charged. <br /><br /> Lenders are keen to take remortgaging customers and make it easy to switch. Some even have special departments set up to handle remortgages. <br /><br /> Remortgaging should take no longer than a month whether you are moving from one lender to another or simply moving to a better deal with your existing lender. Always ask for a timetable at the start of the process so you know what should happen when. <br /><br /> And if you are on a deal with a specific term put a date in your diary to start searching for a new mortgage at least three months before the end of the deal.     <content:encoded><![CDATA[ * This article discusses the extent of the Racketeer Influenced and <a href="http://www.artwoo.com/tag/corrupt+organizations+act" rel="tag">Corrupt Organizations Act</a>'s (RICO) jurisdictional power over out-of-<a href="http://www.artwoo.com/tag/state+defendants" rel="tag">state defendants</a>. Courts have split on which subsection of 18 U.S.C. Section 1965 to invoke. Depending on which subsection a court chooses, certain restrictions and liberties arise that may run afoul to the <a href="http://www.artwoo.com/tag/due+process+clause" rel="tag">Due Process Clause</a>. This is Part I of a two part series. <br /><br /> With the venue provision of the <a href="http://www.artwoo.com/tag/racketeer+influenced+and+corrupt+organizations+act" rel="tag"><a href="http://www.artwoo.com/tag/racketeer+influenced+and+corrupt+organizations" rel="tag">Racketeer Influenced and Corrupt Organizations</a> Act</a> (RICO), 18 U.S.C. Section 1965, Congress intended to provide an avenue for trying all alleged participants of a conspiracy in one forum - <a href="http://www.artwoo.com/tag/nationwide+service" rel="tag">nationwide service</a> of process. Whether and how the statute accomplishes this goal is, of course, the subject of much litigation and confusion. The Supreme Court has never definitively interpreted this section of the statute, leaving the lower courts in a state of disarray. <br /><br /> The key question is which clause of Section 1965 allows for nationwide service of process. Though it might seem academic - what difference does it make which section spells out the rule so long as the statute allows nationwide service of process? - the question is vitally important to determining <a href="http://www.artwoo.com/tag/personal+jurisdiction" rel="tag">personal jurisdiction</a> over RICO defendants: read one way, the grant of nationwide service of process also confers nationwide personal jurisdiction, while the other reading places limits on the court's exercise of personal jurisdiction over non-resident RICO defendants. The competing readings also create a split as to whether a defendant served via nationwide process must still have minimum contacts with the forum or if only contacts with the United States as a whole are required. <br /><br /> In an attempt to sort through the issue, this article addresses the following questions: (1) does Section 1965 provide for nationwide service of process, and, if so, which section of the statute authorizes it? (2) If nationwide service of process is permitted, are there any limits placed on it? (3) Assuming nationwide service of process is allowed, does the statute automatically confer personal jurisdiction through minimum contacts with the United States, or must defendants still have minimum contacts with the forum? <br /><br /> Which Part of the Statute Governs? <br /><br /> Courts generally agree that the RICO statute authorizes nationwide service of process in some fashion. Some courts rely on Section 1965 (d) to support that decision, while the others have ruled that subsection (b) authorizes nationwide service. The statute reads as follows: <br /><br /> (a) Any civil action or proceeding under this chapter against any person may be instituted in the district court of the United States for any district in which such person resides, is found, has an agent, or transacts his affairs. <br /><br /> (b) In any action under section 1964 of this chapter in any district court of the United States in which it is shown that the ends of justice require that other parties residing in any other district be brought before the court, the court may cause such parties to be summoned, and process for that purpose may be served in any judicial district of the United States by the marshal thereof. <br /><br /> (c) In any civil or criminal action or proceeding instituted by the United States under this chapter in the district court of the United States for any judicial district, subpoenas issued by such court to compel the attendance of witnesses may be served in any other judicial district, except that in any civil action or proceeding no such subpoena shall be issued for service upon any individual who resides in another district at a place more than one hundred miles from the place at which such court is held without approval given by a judge of such court upon a showing of good cause. <br /><br /> (d) All other process in any action or proceeding under this chapter may be served on any person in any judicial district in which such person resides, is found, has an agent, or transacts his affairs. <br /><br /> The majority of courts have ruled that subsection (b) is the basis for nationwide service of process, while subsection (d) is a venue provision. The Second Circuit, in PT United Can Co., was the first court to do a close reading of the statute and to interpret each of the four subsections in relation to the others. When read "sequentially," the court held, the statute "gives coherent effect to all sections of Section 1965, and effectively provides for all eventualities without rendering any of the sections duplicative, without impeding RICO actions and without unnecessarily burdening parties." The Second Circuit interpreted - and the majority of courts have since agreed - the meaning of the sections as follows: <br /><br /> (a) Section1965(a) sets venue so that "a civil RICO action can only be brought where personal jurisdiction based on minimum contacts is established as to at least one defendant." <br /><br /> (b) for other parties not residing in the district, Section 1965(b) provides for nationwide service and jurisdiction, subject to a showing that "the ends of justice" so require. <br /><br /> (c) subsection (c) governs service of subpoenas on witnesses. <br /><br /> (d) Since (a) and (b) relate to serving a summons on a defendant and (c) concerns subpoena of a witness, the reference in subsection (d) to all "other process" means everything that is neither a summons of a defendant nor a subpoena of a witness. <br /><br /> A recent Tenth Circuit decision, Cory v. Aztec Steel Building, Inc., noted that not only did this reading make sense, but it also was consistent with congressional intent: <br /><br /> In its report on the Organized Crime Control Act of 1970, which gave birth to RICO, the House Judiciary Committee declared that "[s]ubsection (b) provides nationwide service of process ... in actions under section 1964" ... and that "[s]ubsection (d) provides ... all other process in actions under the [entire RICO] chapter." <br /><br /> This "sequential" reading shows that subsection (d) means something other than that already stated in the previous sections. <br /><br /> The subsection (d) theory, on the other hand, is the minority position, supported only by the Fourth and Eleventh Circuits. Neither court offered much analysis to explain this position, but a number of district courts have since clarified: they reason that subsection (b) "is implicated only when venue is proper as to at least one defendant but challenged as improper by another." For all others - any defendants who do not challenge venue - subsection (d) would provide the basis for personal jurisdiction through nationwide service of process. <br /><br /> One of the few commentators to have addressed the issue, and who supports the (d) reading, explains it like this: <br /><br /> (a) the first subsection does not authorize process, but expands venue from rule 4's provisions; <br /><br /> (b) subsection (b) grants national service of process if at least one defendant is within the court's jurisdiction and "ends of justice" allow it; <br /><br /> (c) subsection (c) authorizes subpoenas over witnesses; and <br /><br /> (d) finally, subsection (d) authorizes service of process on defendants generally; "all other process" means service of process on defendants where no other defendant is properly within the court's jurisdiction, but process can only be served in a judicial district where venue could have been appropriate under subsection (a). <br /><br /> Subsection (d) in this reading can only authorize nationwide service of process because proponents believe a RICO action may be brought in a district where no defendant has minimum contacts with the forum. This leaves virtually no limits on service of process. <br /><br /> Limitations on Nationwide Service of Process Under Section 1965(b) <br /><br /> Where subsection (b) is the statutory basis for the exercise of personal jurisdiction, as opposed to subsection (d), there are limitations on the exercise of personal jurisdiction. First, personal jurisdiction over at least one RICO defendant must be established via a typical minimum contacts analysis. Unlike the subsection (d) school, this branch reads subsection (a) and (b) together to limit filing a RICO action to a jurisdiction where at least one defendant is subject to personal jurisdiction. Even once the court has jurisdiction over that initial defendant, nationwide service of process and personal jurisdiction over the others may only be exercised where the ends of justice require. "[M]erely naming person in a RICO complaint does not, in itself, make them subject to section 1965(b)'s nationwide service provisions." <br /><br /> Congress did not define "ends of justice," leaving the courts to determine the contours of this limitation on nationwide service of process. The prevailing test for "ends of justice" has been whether all the defendants are amenable to suit in another forum; if so, the "ends of justice" do not require exercising personal jurisdiction over all the defendants. Unfortunately both of these lifestyle issues are a direct result of the modern society in which we live; a society in which children play computer games and watch television rather than play outside; and a society in which convenience foods have replaced natural foods. <br /><br /> Addressing these causes of obesity in children require focusing on these lifestyle issues and making modifications while the child is still young enough to ingrain these new habits into their life. Limiting television and computer play and encouraging sports, exercise, and physical play is the first step. The other step is minimizing processed, high fat foods and instead focusing on whole, natural foods such as fruits, vegetables, whole grains, and lean proteins. Additionally, soft drinks and high-sugar fruit juices should immediately be replaced with water or low-fat milk. <br /><br /> Clearly, these are not easy changes to make. If they were then adults would not have their own weight issues with which to contend.
