Finding a lease.

So once you understand what a lease is, the next question becomes, "Where does one find a good ?"

That's an excellent question. One in fact, that I was having trouble solving for the scope of my book, How to Find That Quality Tenant. , as I wrote the chapter on , I was determined not to let the problem stop me from helping you find or develop a good lease. Therefore, let's begin with me telling you how you go about finding a lease that best fits your needs. As far as I am concerned there are basically three ways. I'll list each of them along with the advantages and disadvantages associated with each choice.

Draft your own. (Should you choose to do this, read my article on the contents of a lease available on the articles page at http://www.findthatqualitytenant.com to better understand what should be in a lease)

The advantage: it is cheap.

The disadvantage: you could make some costly legal mistakes by not having enough information or the wrong information in your lease.

If you choose to draft a lease yourself, there are books you can purchase that will walk you through the process, although I cannot say how well they work, because I have personally never tried to draft my own lease.

You can pick one up at an office supply store.

Advantage: It is easy to do.

Disadvantage: It could be too general to offer . When you need a lease right now, these store-bought leases can do the trick since they are so easy to find. They are cheap and simple but will offer the least amount of protection out of the three lease options.

You could have a real estate lawyer draft you a lease.

Advantage: It is tailor fit, offering you the best overall protection.

Disadvantage: It is more costly, although not nearly as costly as a poorly drafted lease followed by a tenant dispute.

As you can probably guess by that last comment, I recommend using a real estate lawyer to draft a lease. They know the laws for your state, county, and locale, and have a good idea which landlord/tenant disputes are most likely to trip you up. Let their expertise and past experiences work to your advantage.

In addition, when you are a landlord, you have at least some financial net worth; definitely more than your tenants will have. This automatically makes you prone to frivolous lawsuits and unwarranted demands by those tenants.

A properly drafted lease will offer maximum custom protection against many of the possible lawsuits and demands landlords are exposed to. Therefore, I would advise you to have a lawyer draft your lease and to do it from the time you put that first tenant in your first rental.

I know money can be extremely tight when you are first entering your landlording career, but I highly recommend using a lawyer from the beginning for this reason. If you draft your own lease or use a store-bought one and you have reasonable success with it for a couple of tenants, you could be lulled into a false sense of security. When you reach this point, you will never pay a professional to draft a lease for you until you end up with a legal dispute, which may of course, be too late.

Take my recommendation and spend the money initially on a lawyer structured lease.

Most companies don't do nearly enough of that. In 2003, just 7 percent of training budgets in the US were spent on first line leaders and most of that was for learning administrivia and for prophylactic HR.

The fact is that don't get much training at all and precious little of it is actually about leadership skills. Maybe that's because companies think they're by not investing in front line leader training.

True, there's no budget line item absorbing funds that might be spent on the executive dining room, or art for the CEO's office. But there are what economists call "s," the costs of not training front line leaders.

There's the opportunity cost of lost productivity. Good leadership builds both morale and profitability.

There's the opportunity cost of lost leadership. Great companies develop most of their own leaders. If you have to go outside for leadership you incur recruitment costs and transition costs.

Finally, there's the cost of lawsuits. Good frontline leadership creates organizations where lawsuits are less likely. And, ff the company is sued over a supervision issue, defense will be easier if the leaders have been doing their jobs.

Another real danger here is that the legislators are apt to accept the currently proposed AER bill because certain entities () have threatened to re-introduce the issue upon defeat and include increasingly damaging restrictions to affect the industry. This is not about our protection. It is really about obtaining votes from an uninformed public by politicizing a nonexistent danger.

The AER bill before Congress is not a new issue. A very similar bill was defeated before the California Assembly in August of 2004. Many of the aforementioned reasons logically came into debate at that time. Wisely, the bill was seen for what it really is and was soundly turned away. The recent reasoning in Washington is that State-by-State regulating of nutritional supplements is practically non-existent, and when given the opportunity, as in California in 2004, "small-time" lawmakers from these States will completely botch the chance to adequately "protect" the average clueless consumer from this "real danger".

Despite the resistance from Robert Brackett, director of the Center for Food Safety and Nutrition (CFSAN) at the Food and Drug Administration, Washington presses on. Mr. Brackett stated, in so many words, that there is existing and sufficient regulatory authority already in place through the Dietary Supplement Health and Education Act (DSHEA). He further stated through testifying before Congress that the current administration has no plans to change current policy. He believes in the rights of the private citizen to make their own informed health choices when it comes to supplements.

The general manager for NSF International, Kathleen Jordan, testified at the same hearing before Congressional lawmakers that the development of the Dietary Supplement Certification Program speaks volumes for informing and allowing consumers adequate protection from the unregulated sale of supplements. The non-profit and non-government organization is leading the way in sane and fair ideas like the recently developed NSF/ANSI Standard 173, which ensures proper nutrient count and identification of contents. On one point, everyone seems to be in agreement. That is, tighter control of anabolic steroids that were once contained in products marketed as "sports supplements". The misuse of the term "supplement" in this case is one of the reasons that people are confused on the difference between dangerous substances like steroids and harmless nutrient supplements like vitamins, minerals and herbs.

Most people who take vitamins and supplements are on their self-imposed schedule that is usually based on the recommended daily allowance (RDA). I take vitamins and supplements every day and the amounts I take are based on the RDA, and the recommendations of my physician. In other words, I have supplements in my system all the time, as I routinely stay on schedule with this. If I were to believe that RDAs of vitamins, minerals and herbs would adversely affect my health in any way, I would stop taking them immediately. Many people that hear of this bill before Congress are going to believe that a real danger does exist just because it is at issue. Others, who inevitably experience failing health in one form or another, will also remember that a dietary supplement debate raged on for years.

If the outcome of the legislation is to allow frivolous lawsuits to ensue, they will surface, even if the supplements have absolutely nothing to do with their ills. The eventual outcome, sadly, is predictable. Every ailment known to man will be blamed on these harmless supplements, the industry will be forced to regulate in order to protect their bottom line, and you won't be able to get dietary supplements without a prescription from your MD. When you then drive to your local drug store and are forced to pay hundreds of dollars for mere dietary supplements, remember that you had this one chance to voice your opinion by writing, calling or emailing your Senator or Congressman.

Credit Bureaus Can Be Stubborn

In spite of the fact that the credit bureaus are required to comply with a request to remove prior derogatory information they are typically slow to cooperate. A bankruptcy attorney will often submit a request to the bureaus to remove derogatory information. The majority of these requests are ignored or only partially completed. And so, in a terribly large number of cases old information will linger for up to seven years depressing the consumers credit score and making it impossible for them to get credit.

Anyone who has attempted credit repair on their own is aware that the experience of dealing with the credit bureaus can be frustrating. Minimize Your Communication

I know that there would be nothing frivolous about your personal story. But every single extra bit of information that the clerk has to get through before they get to the essential documentation increases the possibility that you will get thrown in the "frivolous" category. Keep your communication to an absolute minimum. They will appreciate it and you will be rewarded with success.
