If you are thinking of starting your own franchise you must do your research beforehand. Even though franchises usually lend themselves to success, they can fail. Or they may not live up to what you expected in the beginning. So you should definitely take your time find the one that meets all of your needs personally and financially. You can do research online, read about franchises, consult with the franchisor, or even get a franchise attorneys advice, but the best thing you can do is contact current franchisee's who own the same franchise you are looking to start. You will hear things from the people who are doing exactly what you want to do, what could be better. So, you should absolutely contact current franchises that you are interested in!

The franchisor may take you to meet certain current franchisees so that you can see how they are doing, what they do on a daily basis, and how successful they are doing with the franchise. This can be a good experience, but remember the franchisor has chosen those franchisees for a reason. Also in that situation you may feel uncomfortable asking certain questions while the franchisor is there. So, you may choose to go back and visit them on your own time and ask those questions. This can be great deal of help for you.

But, you can also just select some to go into and ask the owner questions about how they do things, if the franchisors systems work, how supportive the franchisor is, how trustworthy or honest they feel the franchisor is, and their overall opinions of that particular franchise.

Make sure that when you are choosing franchises to visit that you choose different ones. Choose to visit franchises that are in all different areas. What works or sells in one place may not move in another area. Also choose to visit franchises that have been around for some time. They will be able to help you determine the long term success of the franchise. Also choosing to visit a newly started franchise will help you as well. It can help you to see how well the franchisor deals with new franchisees. Visiting franchises that are doing well can benefit you since they may be able to give you pointers and advice since they are doing well. You should also consider visiting a franchise location that is not doing so well. This may be able to show what does not work so that you can avoid it. But also it will allow you to see if the franchisor is in any way responsible for the lack of success. Or you may be able to see if that franchisor helps or supports those franchisees in a time of need.

It is important that you visit and talk with as many current franchisees as possible. This will be able to give you the best idea of how that franchise and franchisor operate. That way you will not be blinded or mislead in any way. You should know as much as you can before you make such a big decision.<bio>For more information on an automotive franchise, visit BumperDoc auto body franchise and start your path to business ownership.</bio>

As with starting any business or franchise you want to know that you will have the best chance at success as possible. If you start you own business or franchise the one thing you don't have any control over is who opens up next to you or near you. This is an area of concern for franchises since you hold the same name as many others. For example if you owned a BumperDoc auto body franchise you would not want another BumperDoc auto body franchise to open on the same intersection or plaza as you. So a good question to ask your future franchisor is if they will limit competition in any way.

Normally what the franchisor does is give you a certain amount of territory in which you can operate. They will usually put in the contract that another one of their franchises will not open within a certain mile radius of your franchise location. Remember you want to have enough business to keep your franchise going for a long time. The franchisor may try to tell you that what they offer is great or plenty. However, you need to take a close look at where you are opening your franchise. If you are in a heavily populated area then an 8 mile radius may be just fine. But if you are in an area in which not very many people live, 8 miles would not be a good offer at all.

Also once the franchisor tells you the limitations of competition from them and you agree with it make sure it is in your contract. This is very important. The franchisor and you are held to the contract, not a verbal agreement. So, if you don't see it in the contract or if it is incorrect in any way do not sign unless it is corrected first.

If you are unsure of the franchisors agreements in this area you may want to consult a franchise attorney. Having a franchise attorney can be of great help to you and can be the key to your success as a franchise owner!

Keep in mind that even if the franchisor sets limits or territories for their franchises there is no way for them to keep other competition from other business and franchises away. For example with your BumperDoc auto body franchise, there is no way for BumperDoc to keep another franchise such as Collision on Wheels from opening up next to you. You will most likely always have some kind of competition near you; you just don't want it to be coming directly from your franchise family.

Since you cannot control the other competition that is around already or that may move in to the area, it is important that you choose a good location for you business! You must choose a location that will produce the greatest gains for your franchise industry and market.

Lastly, if the franchisor does not offer any limitations of competition or territories you should definitely think twice before beginning your franchise career with that franchisor!

Find a franchisor that meets all of your needs and that will help put you on the path to success!<bio>For more information on an automotive franchise, visit BumperDoc auto body franchise and start your path to business ownership.</bio>

Deciding to join a franchise family is a great opportunity with many benefits. Many of these benefits you will not receive if choosing to open your own independent business. You will receive training on the franchise system, you will be part of a big network that can provide assistance to you when needed, and you will be investing in a business that has a higher rate of success than an independently owned business. But another great benefit you will receive is a marketing advantage! Not only would you be buying a well known name or brand, but should receive additional marketing for your franchise!

When you decided to purchase a franchise you will need to consider the marketing plan that the franchisor provides. A marketing plan outlines the specific actions you intend to carry out to interest potential customers and clients in your product and/or service and persuade them to buy the product and/or services you offer. So, this is something that the franchisor will provide per your franchise contract with them. The marketing that the franchisor provides is a big reason why franchisors have a higher potential for success, so if you don't agree with the plan or there isn't one look for a different franchise.

Marketing for your franchise is an important facet to running your franchise successfully. You will want to ensure that your franchisor offers a great marketing plan that will help generate business for your franchise. The franchisor will have a fee that you will pay for marketing. Since, this is something that you will be paying for, so make sure you get the most for your money.

The marketing plan should cover such expenses as print advertisements, TV commercials, and direct mailings to both potential and existing customers. Also a good plan to look for is one that covers fees that you may pay for advertising agencies for in-house marketing. You want to make sure that you are reaching any potential customers so you will need to have advertisement in as many different forms as possible. For example, if you only put a newspaper ad out, only the people who read that certain section of the paper will see your advertisement. You will want to make sure that their plan is suited for what you are selling, and that it reaches out to a wide variety of people. You will be limiting your franchises success if your franchisor does not have a complete and effective marketing plan.

Another aspect to consider is whether the franchisor will listen to marketing suggestions from franchisees about future marketing. A good franchisor will, since this is a way to stay fresh with their marketing and gain many new ideas that can lead to successful for the whole franchise family. Times are always changing so in order to keep up with them you do have to change a little. What worked 15 years ago, is most likely not what is going to work currently!

So, make sure that you find a franchisor that provides you with a great marketing plan, since that is what they are supposed to do to keep the entire franchise family successful!<bio>For more information on an automotive franchise, visit BumperDoc auto body franchise and start your path to business ownership.</bio>

If you start your own business and it is successful you make think of opening a new location for you business so you could make more profits. This is one option; however you could turn your business into a franchise and become a franchisor. A franchisor is the person whose business idea, process, product, name etc is being used by a franchise holder or franchisee. Therefore the franchisor creates a business and a proven system and then give's other's who are called franchisees the right to mimic their business by using their name, selling their product or services and their proven system. So, why do people choose this franchise concept?

Becoming a franchisor has great benefits. One of the biggest benefits is that they are able to expand quickly and at much less the cost of opening a new location. Having more locations and in many areas will bring greater gains for the franchisor. Also the more locations they have the better they can offer their products and services to a wider variety of consumers. The franchisor will have fewer direct staff and also less staff problems. Also they franchisees will pay for the franchise and may also have other fees to pay continually so the franchisor will have continuous income from royalties which are based on the franchisees gross sales and/or fixed fees. They also have the benefits of purchasing power and purchasing in larger volumes which can be cost effective. Another big reason to become a franchisor is that are constantly getting new business and marketing techniques from their franchisees. Many franchisors report that they get 90% of their new marketing ideas from their franchisees who are dedicated to their franchise and franchisor. The franchisor can get to the point where they can step back and let the franchisees continue to achieve financial and business growth and they can live the lifestyle they so choose with a great income.

The only way this works is if people buy a franchise from them. So, why would someone choose to buy a franchise? There are many benefits associated with buying a franchise business. For example there is less risk involved with buying a business that has already established a name for itself has a proven system and has ongoing training and support. Starting an independent business does not come with those perks! It is also proven that starting a franchise business holds a greater chance for success then starting your own independent business. Also there is less involved with a system that already works especially if you will be provided training on that system. Another great benefit of being a franchisee is you get incredible marketing advantages. Even if your name is well known already, most franchisors provide marketing as part of your deal. If you see a commercial for a franchise business, all the franchisees reap the benefits of it!

Becoming a franchisor is great choice if you want to expand your business and make the money you have always dreamed of!<bio>For more information on an automotive franchise, visit BumperDoc auto body franchise and start your path to business ownership.</bio>

What are the advantages and disadvantages of franchising?

You have decided to buy a franchise. Which one will you choose? There are so many out there. Are you going to go for a coffee shop or fast food outlet? What about an internet business, printing company or stationary?

There are distinct advantages in buying a franchise over starting your own business from scratch. The greatest advantage is that most franchises are still trading after 3 years whereas most new start ups have ceased trading.

What is a franchise?

With a franchise you benefit from a proven business model and the experience of a larger organisation. You have to pay a franchise fee and a license fee to the franchisor to have the right to run their business model.

In the UK companies like McDonalds, Prontaprint and KFC made franchising very popular in the 70s. Now you can find an outlet in nearly every town and city in the UK. Franchising is now one of the fastest growing areas of business in the UK.

Let's examine the pros and cons of franchising

The advantages are:

1) You receive full training in the operation of your business 2) You are not reinventing the wheel 3) You receive support from the franchisor when you encounter a problem 4) You have a proven business model 5) It is in the franchisors interest for you to succeed 6) Accounting procedures and business systems are well established 7) You are part of a group of people all running the same business 8) You benefit from national marketing

The disadvantages are:

1) You have to pay the franchisor a percentage of your profits 2) You have to follow the guidelines laid down by the franchisor 3) The Franchisor controls the development of your business 4) The Franchisor dictates your supply chain 5) You have to market the business in a way that is approved by the Franchisor 6) You have to report back to the Franchisor at least annually

Before you jump in

Before you commit to a franchise make sure that you evaluate the following points:

1) Take professional advice from lawyer before signing any agreements 2) Take advice from an accountant to check the viability of the business 3) Carry out market research to see if the franchise is right for your area 4) Be prepared for hard work - running a business requires commitment

If you're ready to make the commitment, franchising can be a rewarding, and often highly lucrative business. <bio>Business Franchises and UK Business Directory http://www.citylocal.co.uk Business Franchise Opportunity http://www.citylocal.co.uk/frontend/franchiseinfo.php?cityid=79

Business Franchises and Ireland Business Directory http://www.citylocal.ie </bio>

When it comes to business there is a whole lot of lingo out there that can be confusing. One example is that of a franchise or a licensed business opportunity. Anyone looking for business opportunities must understand what a franchise is and what a licensed business opportunity is. This brief overview will help you understand the differences.

First of all, a franchise is simply a business model that has been proven to be effective. The franchisor who created this business model will then sell you the rights to use the business model as well as the services or goods that particular system sells. Once you pay your franchise fee you will become a franchisee and have a relationship with the franchisor to assist you with the system. A franchise agreement will be signed and this agreement outlines the assistance the franchisee will receive through the franchisor and the business model. A franchise owner must pay royalty fees to the franchisor. Also, a franchise owner must follow the business plan exactly as it is. If any changes are to be made they must first be approved by the head office. Of course, with a franchise you will get a lot of support and a readymade plan to follow. Some franchises are better than others at helping their franchisees become successful, but most do everything possible because the name of the franchise is at stake. Marketing fees are also paid by most all franchisees to the franchisor. That's because the franchisor is marketing and advertising the product/service to the benefit of all franchisees and they pay a yearly fee towards that.

A licensed business opportunity is a business opportunity not unlike a franchise, but it is set up a bit different. First of all a licensed business does not require royalties nor does it require that you pass off all decisions with the head company. A licensed business opportunity is generally significantly more affordable than a franchise. That's because the license is all that is purchased, not the entire business model so there are no franchise fees, marketing fees, or royalties to pay. Most licensed business opportunities also do not require marketing fees. Many have graphics that may be used with instructions, but no set marketing fee that must be paid.

As you can see franchises and licensed business opportunities are not the same thing. They both offer the opportunity at a new business, but the way that business is managed and the fees that must be paid in association with the new business are significantly different. Keep in mind that there are benefits and drawbacks associated with both franchises and licensed business opportunities. You must weigh the advantages and disadvantages before making a decision to go ahead with any particular franchise or licensed business opportunity. <bio>Find franchises, franchise opportunities and information for entrepreneurs at http://www.franchisegator.com Franchise Gator. </bio>

It is so easy to get caught up in the moment. You might get so excited you almost forget which way is up or down. Deciding to buy a franchise can give you these exact feelings. You will actually have the chance to be a business owner, to use your skills and ambition to run a successful business, and to choose how your life will happen instead of letting others decided. However it is very important that you slow down a little bit and really think things through so you can make the best decision for you. There are many franchises available to choose from all with different things to offer. Along with the things to offer is also a contract. It is important that you fully understand your contract before signing up for any franchise opportunity.

The contract is a legal document which is binding to the franchisor and franchisee. It will state what the franchisor expects from the franchisee, what they will provide to the franchisee, and other things of that nature. It is probably one of the most critical steps to beginning as a franchisee. You must understand fully and competently what you are signing your name to. That is your legal agreement between you and your potential franchisor.

You may choose to have an attorney to help you with the process, which is a good decision. An attorney can help you work through some of the possible confusing lingo that is in the contract. You would not want to become a franchisee and be upset with possible situations that may not occur in your favor simply because you did not understand something in your contracted agreement which you signed.

The first thing you will do with your attorney is review the contract that the franchisor presents. You will want to check to see if it is the same as they have verbally spoken and promised to you. If there is something that is not right or that you were not informed of with which you disagree, you should contact the franchisor about it. You can ask them to make a change to the contract that can be a compromise to you both. However if an agreement cannot be reached then you may want to just move on. There is no sense in wasting your time, money and effort on something that will not benefit you in the long run or even now. There are so many other franchises out there to begin as a franchisee.

However if you think the contract is favorable to you make sure you are 100% sure. The franchise contract will contain many aspects of the agreement. Things it will cover are the price the franchisee will pay, what will be included in the package for that price, what services the franchisor will provide to the franchisee, the rights you have as a franchisee, your obligations to the franchisor as a franchisee, and the termination process of the agreement. These are all critical aspects to consider before you sign your name on the dotted line.

Franchising can be a great opportunity and you can be very successful with it, but you must understand the agreement first before you get involved in such a great investment!<bio>For more information on an automotive franchise, visit BumperDoc auto body franchise and start your path to business ownership.</bio>

Franchising is practiced in many business establishments today. With franchising, the franchisor generally licenses its trademarks and business modus operandi to the franchisee. This is done in exchange of a recurring payment from the franchisee which may be a percentage of gross sales or gross profits and annual fees. Businesses working as franchise arrangement are referred to as chain store, franchise or franchise outlet.

The advantage of franchising lies in the fact that the franchisor is still in command of the financial part of the business. The franchisee only pays the franchising fees and other commitments while the assets are controlled by the company. Moreover, with franchising, the franchisor provides trained employees for the franchise. In fact, if required, they will also provide the necessary training to the employees, wherein the franchisees save in training costs.

When entering into a franchise agreement, it is necessary for the franchisee to pay some capital amount as security deposit to the franchisor. With this payment, the franchisee runs the franchise with the needed dedication as they will not want to lose the capital sum to the franchisor. As the company would have already had a good standing in the market, and allots franchises just to expand, there is not much of a hassle in getting customers, and business to the franchise.

Franchising helps in the growth of a business as there are no limits to the number of franchises to a company. It is in fact much easier to open franchises of a company, than branches of a business as the cost involved is much lower. Moreover, the franchise receives franchise fee, franchise royalty, better lease options, discounts on equipment and raw materials and discounts from vendors. So they basically have more money to run the franchise than an individually owned company or companies. <bio>Our experts have made a research and found the best franchise opportunities.
Franchisees need to dismiss the notion that 'royalty fees' are an extra payment coming out of their pocket; they are a part of the process of partaking in the franchise system. It should be looked upon as the Franchisor's share in profits derived from the consumer. The Franchisee gathers the royalty fee sum from the consumer along with the rest of the funds that keep the whole enterprise going.

The royalty fee is another aspect of the business and no business would be in business if they were not making their money from the consumer. The consumer pays for the Franchisee's overhead, costs of sales, salaries, and of course the profit. It all stems back to satisfying your consumer who ultimately pays for the business to run.

The Franchisee should be happy to contribute back into the system that feeds them. A Franchisee should know that a stable, dominant, and flourishing Franchisor will only make the 'name' of the franchise stronger creating more of a stir in the business and thus generating more potential consumers. If the root of your business franchise remains strong, the whole system will follow suit including all Franchisees.

The whole dynamic of the business franchise opportunity is founded upon the Franchisor initially providing a desirable product and/or service to the consumer. The appeal of the Franchisee to become a part of the franchise is based on the success of the initial Franchisor. The Franchisee makes a solid business decision to engage into the 'family' of the franchise that appealed to them in the first place. The Franchisee carries on the tradition of the Franchisor. It is like an apprenticeship as far as the Franchisee emulating the Franchisor, but thought the Franchisee does have some autonomy, their business still is directly effected by the 'name' of the initial Franchisor and this is why they collect a fee.

Considering how much direct and indirect support comes from the Franchisor, royalty fees should not be seen as a monumental strain on the Franchisee. Franchisees always have the opportunity to build upon the root of the franchise, but they must not lose sight of how they have been provided with such an opportunity. Lets think about four elements of a franchise: the brand, operating system, support system, and the Franchisee.

The Brand is the name associated with the product and/or services. To be in a position to provide opportunities to branch out, the Franchisor already has made initial strides for Franchisees to come. The Operating System is tied in with the Brand in the sense that there has been a tradition instilled into society that is recognizable and can be replicated in the same memorable fashion over and over again through Franchisees.

The genesis of the Support System is aided by the presence of more and more stems from the initial Franchisor. The Support System helps the Franchisee them selves develop a memorable and stellar system such as the initial Operating System of the Franchisor. The Franchisee is improving their performance based on being a part of the larger system of the franchise.

If a Franchisee evaluates the importance and contribution of the Brand, Operating, and Support Systems then the royalty fee can really be put into proper perspective. The Franchisee is virtually dependent on the initial and continued success of the franchise that they chose to be a part of. Embracing all these insights should change any negative feeling about paying a royalty fee.

Most royalty fees range from 2% to 10% depending on the nature of the business. So even if you're a Franchisor who is paying the 10%, you have to consider if the Brand, Operating, and Support systems are feeding at least 10% into the individualized Franchisee's business, which most likely it is exceeding. <bio>FranchiseFetch (http://www.franchisefetch.com) links the public with a multitude of pre-established, successful, money-making franchises.
If you are making the choice to become a <a href="http://www.artwoo.com/tag/franchisee" rel="tag">franchisee, chances are you have done some of your homework. You most likely know that franchises have a great opportunity for success, usually much higher of a chance than if you were to start your own independent business. In addition to that you will be able to be your own boss. You will also be investing your time and money into something that could be very profitable. You may already know that you want to become a franchisee, and maybe somewhere you have heard of multi-unit franchising. So, at this point you may be wondering if multi-unit franchising is a possibility and if it is a good choice.

First of all, you must understand what multi-unit franchising is. Multi-unit franchising is when a franchisee purchases more than one franchise from a franchisor. So the franchisee may have units in multiple places around town or even in different countries.

Now, whether this is a possibility or not depends on the franchisor. Some franchises are set up to allow multi-unit franchising. However some either are not set up in that manner or do not like the idea of allowing the concept. So, you will need to check with your potential franchisor and ask them specifically if they allow this. Also, you will want to make sure that it is included in your written contract with that franchisor if you choose that franchisor.

There are numerous benefits to starting or buying more than one franchise. Right the beginning your franchisor may reduce your opening fees if you agree to opening a certain number of franchises. They may also provide you with an exclusive territory for a certain time period. This is a great advantage as you will be able to get established and start making profits quick. They may even reduce your royalty fees if you the franchisee agrees to support your own units. They may even allow you to purchase another site for your territory with no fee or a minimum fee. All of these types of benefits will not be offered with every franchise. So you will need to check with the franchisor to see what types of benefits they will provide to a franchisee who wishes to open multiple units.

You will also receive ongoing operating benefits. You will be able to share your staff among the different locations you own. You will have advertising gains since you will pay a certain amount but also be covering all your locations. You will also have an advantage at establishing a strong management team with a wide variety of qualified employees from all of your locations. Also you will be able to save money by buying goods in a larger quantity and sharing through your locations.

While you will receive many benefits from multi-unit franchising there are still other things to consider. You may want to only open one at a time, since each one will require much time and effort on your part. Therefore you will be better prepared for the locations that you open later. Also, be careful in your decision as you will be putting all your money in one pot. Deciding to open multiple franchises can be very risky, however you can also make more profits and enjoy the benefits your franchisor provides to franchisees with more than one unit!<bio>For more information on an automotive franchise, visit BumperDoc auto body franchise and start your path to business ownership.</bio>

If you are embarking on being a franchisee, you have made a great choice. You will be investing your money and time into something that can bring you great successful personally and financially. You will become your own boss and have great satisfaction in saying you own your own business. However, you may be thinking you want to achieve greater successful as a franchisee by starting more than one franchise. The concept of starting more than one franchise can be very risky or have the potential to be very successful! You may have found several franchise opportunities that you would like to invest in.

Choosing which franchise can be a hard decision especially if you are wanted to open more than one.
If you have more than one franchise of interest and have the money and business skills needed you may be thinking of opening different types of franchises to challenge yourself and increase your potential profits.

The very first thing you need to do is research if the potential franchisor allows you to purchase different franchises. Many franchisors will only allow you to own or operate other businesses while owning a franchise from them. They make want you to focus on their brand and making it a success. Also they may not feel that you will be truly dedicated to their brand if you are branching in different directions. So, before you get to involved you need to figure out if the options you want will be available to you if you choose a certain franchise. Remember you will have to be equally and fully committed to each franchise you start.

Also, keep in mind that if you decide to open multiple franchises of different types they will each come with their own contracts from each franchisor. This means you will be learning multiple businesses at one time and learning to comply with each franchisor separately. This can be quite a big task to take on. So you may want to consider opening them at separate times from each other to avoid being in the middle of a tug a war match.

One good thing about opening different types of franchises is that you are not putting all your money in one pot. If one does not do well or is not suited for you it will only be one versus if you bought multi units from one franchisor.

Buying multi units from one franchisor is another alternative that you have if you wish to open more than one franchise. This can be a great benefit to you since you will gain operating benefits from it as well as start up benefits from the franchisor. Because it is only one franchise you will only being learning one new business system. You may also have more power in the franchisors opinion since you own more than one franchise from them.

The choice is ultimately up to you and you must decide what is right for you! What works for one person is not what will work for another.<bio>For more information on an automotive franchise, visit BumperDoc auto body franchise and start your path to business ownership.</bio>

How can <a href="http://www.artwoo.com/tag/franchisees" rel="tag">franchisees maintain proper relations with their franchisor? A lot has been written about how franchisors can promote positive relations with their franchisees. Franchisors should maintain proper dialogue, reward the best performing franchisees and hold regular meetings. I believe that the duty also lies with the franchisee to help the franchisor achieve his goals of maintaining proper and profitable relationships both parties.

Most franchisors aim to provide the ultimate in training, support and service to their franchisees. After all if the franchisees are successful then so will the franchisor. It is actually quite amazing how few franchisees take advantage of this relationship and utilise all that is available for them.

Maintaining daily or weekly dialogue with franchisor is essential. After all, they have the expertise and the knowledge to help the franchisee overcome most problems. If the franchisee does maintain regular contact then the franchisor will always be thinking of new ways to help him or her. They will also be keen to impart their knowledge which has taken them years to acquire.

The franchisees should ensure that they attend most if not all conference calls and annual meetings. These are usually motivational and help to maintain relationships not only with the franchisor but with the other franchisees. They are also important in keeping up with new product developments and ways of working.

Instead of complaining to other franchisees of any short comings it is vital they are brought to the attention of the franchisor in a friendly and helpful manner. Most franchisors are continuously striving to improve their training, ongoing support and product development. By bringing these matters to their attention in a courteous manner the right results can be achieved.

Many franchisees are happy to make snide remarks to other franchisees without bringing the matter to the attention of the franchisor in a professional manner. This leads to small petty differences getting out of hand.

It is essential when these discussions are ongoing that they are communicated via email and letter and then discussed on the phone. Written communication can ensure that you the franchisee receives prompt attention to any queries. Franchisors do not want to be seen to not responding to any written suggestions or comments. This way both of you are sitting at the same side of the table trying to find solutions that work for both parties.

It is imperative that a franchisee only resorts to legal action when all other means of communication have failed. Once the matter takes a legal turn then the relationship is usually damaged for all time. When lawyers are involved usually neither party achieves what the set to do and the only sure fire winners are the lawyers.

When relationships fail between both parties it can ultimately lead to depression for the franchisee. A depressed franchisee is unlikely to put the same effort in maintaining and growing sales in his territory. This scenario could in most cases have been easily avoided if lines of communication had been kept open right from the start. It is a as much a duty for the franchisee as it is for the franchisor to maintain a profitable and harmonious relationship. <bio>Naz Daud http://www.citylocal.co.uk http://www.citylocal.co.uk/frontend/franchiseinfo.php?cityid=79 http://www.citylocal.ie http://www.ecademy.com/account.php?id=120141 </bio>

Deciding to own your own franchise can be a great opportunity and very fulfilling. You will own your own business and have a great chance for success. One of the key contributors of your success will be your franchise contract. If you are new to franchising it can be a little confusing especially since most legal documents are. Your agreement with the franchisor is what will determine the future of your franchise, what you can do, benefits you will receive, and what your franchisor will do for you. Whether you are new to franchising or not it may be beneficial to hire a qualified franchise attorney to help you.

A qualified franchise attorney's help people through the franchise process whether it be a well known franchise or a start up franchise. They deal with the area of law revolving around the right or license that is granted to an individual or group to market a company's goods or services in a particular territory under the company's trademark, trade name, or service mark. These are things you could encounter during the beginning of your franchise career or throughout it. With so many laws it is hard for an individual to know it all, unless they specialize in it as franchise attorney's do.

Your franchisor may offer suggestions for a franchise attorney or where to start, or you may choose to look for one on your own. Either way is acceptable. It is important that you select a qualified franchise attorney for you regardless of how you find them. Some things to consider are followed. You want an attorney that specializes in franchise law. If not they will not be the best suit for what you need. You will also want to find a franchise attorney that has experience. This is a big investment and decision; it is not something you want to chance with an upcoming franchise attorney. You need someone who knows as much as possible and has been practicing for a while. It is advised that you find a franchise attorney that has a concrete knowledge of your states laws for franchising. Ever state has their own laws so it is important that they know what your state's rules are. Also finding a franchise attorney that is an active member of the American Bar Association Forum on Franchising will be something to show they have accreditation and are active with current franchising laws.

You will want someone who knows the laws of franchising as you begin and carry on as a franchisee. They can help you through legal issues that may arise. They can also provide legal council to you as you make decisions for the future of your franchise and you as a franchisee. They may be able to keep you from making costly mistakes either in your initial contract agreement or in maintaining your agreement with the franchisor. Also they may be able to guide you through the correct steps to take if your franchisor is not following their contract agreement with you.

Hiring a qualified franchise attorney is a great decision to make for your franchise and you!<bio>For more information on an automotive franchise, visit BumperDoc auto body franchise and start your path to business ownership.</bio>

When it comes to running your own successful franchise you need to not only assess the franchise opportunity and the franchisor, but you need to assess yourself.

Normally if you were to apply for a job your employer would want to know a whole heap of stuff about you. They will want to see a CV and they will want to interview you ( probably on several occasions). But (and this is a big but) it is very much in the employers interest that they get the right person. If they get it wrong, they could have problems with you doing the job, extra training and perhaps even having to replace you and that all costs money and can damage client relationships. However, you still get your wages to the point they decide to sack you - if things are going really wrong.

So in a typical employee/employer situation the evaluation of your skills and abilities sits with the employer. If they get it wrong, then in the short to medium term they end up counting the cost of this decision and you will probably not suffer too many long lasting effects.

But for a prospective franchisee, you are PAYING money upfront to take this "job". If you are not cut out for the role and the business fails because of that, the person that primarily loses out is you!! The franchisor has your money; admittedly if you continue in business they will also take a percentage and franchise fees from you. But, if you fail they replace you and take someone else's money upfront and perhaps they will work out. You cannot rely on the franchisor to be as careful as an employer would be.

So how can you check you are the right person for this franchising job? You need to ask the right questions of yourself and match your skills and potential with the requirements of running a particular franchise. Our guides tell you how to make this assessment and help make sure you take the "job" that is right for you. <bio>Written by The Franchise Expert - a team of experienced franchisees based in UK.
The decision to buy a franchise is one that requires a lot of thought and quality research to ensure you don't regret the commitment two years into a long-term contract. There are a number of questions you need to ask yourself and the franchisors (sellers) to determine which business is right for you.

The first part to determining the right franchise fit is to look at what kind of a person you are. Ask yourself the following questions:

- What interests, hobbies and passions do I have? Is there a franchise available in my area of interest? There are so many different franchise opportunities available across a whole range of business sectors. Look for the area that suits your personality. You will be making a big investment of time, money and energy so you want to be able to enjoy the business you buy.

- How much capital do I have behind me and what start-up costs can I afford? There is no point researching franchises that are financially beyond your means. Be realistic about your budget and stick to it.

- How many hours a week do I want to work? What days of the week do I want to work?

When you buy a franchise you must commit to being open during the hours that the franchisor (seller) dictates. Find a situation that suits your needs as well as the needs of the company.

Finally, ask your family what expectations they have from a franchise, and what (if anything) they plan to contribute to the business.

Investigating The Franchisor

The second part to finding the right franchise requires you to ask tough questions of the franchisor. This is a person you will be in a business relationship with for a long time; be thorough in your investigation of them and their business practices. Ideally they should furnish you with a Franchise Prospectus when you first express interest in the company.

This prospectus should tell you:

- What kind of franchise it is and what type of agreement you will have with the franchisor.
- Who the Directors are and what business experience they have.
- The company's financial track record.
- Start-up costs and any other costs to be paid by the franchisee (you).
- Any restrictions on activities of the franchisee.
- Success rates and numbers of current franchisees.
- What kind of training and support the franchisor will provide.
- What rights the franchisor has to choose or approve sites for your business.
- Terms of the business agreement in regards to termination and renewal procedures.
- Financial information about original company location.
- Banking information and professional associate list.

Questions to ask the franchisor:

- How long have they been in business? How long have they been franchising?
- Can you talk to existing franchisees to ask questions about the business?
- Where does their main source of revenue come from?
- What financial state is the company in? Ask for bank references.
- What territory can you operate in? Do you have exclusive rights to that area?
- Is training included?
- What are the advertising terms and conditions?
- What are the ongoing royalties and service costs?
- What capital is required and what are the realistic profit projections?
- How many other franchisees are there?
- Do they have any legal cases against them?
- How long will the franchise agreements last?

This list is not exhaustive. Ask as many questions as you can to ensure you invest your money wisely and have many years of good business relations with your franchisor.<bio>Franchise opportunity in Texas offers new and recycled boxes and other moving franchise supplies.</bio>

One of the greatest decisions of any entrepreneur is in the choice of franchise that you buy in to. Therefore, there is a lot of planning and researching that needs to go into the process before deciding on a final franchise.

You need to have goals to work towards. For example, think about why you want to start a business and what you expect to get out of it. You must also think about if you will have the commitment to the business throughout as it can be a long and hard process at times.

Buying info a franchise may cost more or less money than you originally expect so make sure you know what financial requirements are expected of you and if you can afford them. This includes franchise fees, royalty payment terms and other expenses that you may have to pay along the way.

In order for your franchise to be a successful one you must ensure that you have the right qualities and skills. To do this you will need to look at your previous achievements and experiences and assess you areas of strength from these. There are certain maths and English skills that you need to have to become a franchisee of the Subway® restaurant chain. These will be tested before you can become a franchisee. In is advised that you choose a franchise to buy into that can leverage your strong points. Look at the background of the franchisor as you do not want to take up their offer if they have a history of being unreliable and unsuccessful. You will also want to work for a franchisor who treats their franchisees well and gives them support and training throughout the whole business process. You should definitely talk to other franchisees in order to get an idea of how that particular franchisor works before applying to the franchise opportunity.

There may be restrictions within the business that you need to be aware of in terms of outlet size and restrictions on territory. It is advised that you familiarise yourself with these when making your decision. Agreements that you are required to sign will list out rights and obligations of both you and your franchisor and these should be read very carefully, if possible with legal opinion.

Franchise Offering Circular is the franchisor's disclosure document and you should make sure that you ask to have a look at this before you sign up as a franchisee. Reading this will help you to evaluate the financial stability of the franchisor and therefore see if they are financially capable of supporting you as a franchisee. It is law that you are given this document to read at least ten days before you sign up to the franchise.

So, before deciding to start up your own franchise, ask yourself these questions:

• Is training required before starting?

• Where is the best place to start up a franchise business?

• What equipment will be needed in order to start up th franchise?

• How many people will be required to start the operations of the franchise?

You will also need to consider all the risks that you may be open to throughout the business process as this will help you to minimize these risks and make your franchise business a success. You may like to get some professional guidance when choosing a franchise.<bio>James Copper is a writer for http://www.newcareerskills.co.uk</bio>

Franchise business is a hotbed of opportunities. While, this fact remains, a businessman who is dynamic, proactive and looking for some adventure in profession and is capable of taking risks may find himself stranded by a franchise that he is running for some time. A franchise, any one for that matter, works on a set successful model of business and is a repetitive in nature. While most franchising companies think that they follow the best practices, it can get to a dynamic entrepreneur's nerves, more often than not. Whilst may be an option, putting up the franchise for sale is a better option so that one can make more money from it.

Franchises for sale are available everyday. While most of them seem to be restaurant franchises, many other businesses are also seeing the same trend. The reasons may be various, but, the most common reason is that a budding business man has already got bored of it. A businessman when he starts off, tends to take lesser risks, hence goes the franchise way. After a few years, when he learns the ropes of the business and gets more experience in handling the business, the businessman tends to think that he has more to do than running the robotic franchise. Any dynamic businessman would think the same way, and so puts up the franchise for sale.

In case you have decided to put up your franchise for sale, the first thing that you need to do is to contact the franchisor. There is nothing to be embarrassed about, ultimately all of us need to move on in life and so does the franchisor. The franchisor as already taken into account that some of their franchisees will sell off their franchisees at some point of time. Their business plan takes this into account. The reason may be anything and the franchisor may have heard it before, go ahead and do what you need to do.

The franchisor may put up some impositions or conditions on your franchise for sale. Most of these however will be inline with the current guidelines they have for giving out a new franchise. The franchisor would be looking to the ability of approving the new franchise and nothing else.

The next most important thing would be assess the cost of your franchise. Talking to your attorney with updated accounts in the proper structure of sale may be of great help. Taking into account the property lease, stocks and various other parameters, it is important to value your franchise at the correct price.

Answers to all these questions lie in your organization. All you need to do is find them and make the right decision in regard to price and continuity. Talking to a business broker would be a good idea to begin the process. Newspaper advertising, website listing in the relevant category can help accelerate the process of find the right customer for your franchise for sale. Always be sure to have an extensive qualifying procedure in place before selling your franchise to an unknown individual. <bio>Roger Morad is the expert columnist and article writer for http://ModernFranchises.com - He is an industry expert that reports daily on franchising and business opportunity news.
Franchise according to the dictionary means "Granting authorization to someone to sell or distribute a companys goods or services in a certain area or certain places".

Franchise is a license granted by a company or firm on certain terms and conditions to an individual or firm to operate a retail outlet in a specified area or place. The company or firm which grants the license is called as franchisor, where as, the individual who accepts the terms and conditions to operate a retail outlet is called as franchisee. Here the franchisee agrees to use the franchisors brand name, products, services, promotions, selling methods, add display and distributions on certain terms and conditions. The franchisee pays a fee to the franchisor for the license to sell its products, services or goods.

This type agreement helps both parties, the franchisor gets new area to establish business where as the franchisee will get already developed brand products and having no guess work about what to do, because all development and decisions are made by franchisor and everything is laid out, step by step, with nothing missing or left to chance and it all works with precision.

The Legal Aspects of Franchising

In legal terms franchise is a contract. The franchisee is usually granted an exclusive territory in which he or she is the only distributor of the particular products or services in a specified place. The franchisor is obligated to assist the franchisee through advertising, promotion, research and development, quantity purchasing, training and education etc.

In 1979 the United States legislature had enacted the laws to protect prospective franchisees from being deceived by the falsehoods of franchisors. The franchisor has to disclose all financial details such as profit, operating cost, recurring expenses and five year actual sales statement and these laws are known as financial discloser law.

A franchisor also has to disclose the background of the company including the business experience of its high level executives and whether any of its executives, within the last seven years, have been convicted of a felony or involved in litigation franchise business fraud, or have been involved in any proceedings for bankruptcy. In addition to this disclosure factual description of the franchise and statement of the total funds to be paid such as initial franchise fees, deposits, down payments, prepaid rent, and inventory purchases is mandatory. Conditions must also be clear on recurring costs such as royalties, rent, advertising fees etc. <bio>Keith George always writes about valuable news and reviews.
A franchise is a legal agreement that allows an independent business owner (franchisee) to trade using the trademark, trade name and business format of the franchisor (owner of the original business) in return for a fee and ongoing support fees or royalties.

There are many benefits to buying a franchise. The number one benefit of becoming a franchisee is that you will not be starting from scratch on your own. When you buy a franchise you have two distinct things on your side. First and foremost you can take advantage of the name recognition of the franchise. This alone will help you to drive traffic to your business from day one. And of course, as a franchisee you will receive support from the franchisor. Again, this helps during the start up process because you are not forced to do everything on your own.

Another benefit of buying a franchise is that you will be able to control your start up costs. You will get all the details you need from the franchisor, and from there it will be up to you to come up with the exact amount of money that you need. In many cases this beats starting your own business because your costs will fluctuate more than you care for them to.

There are quite a few benefits that go into buying a franchise. If you are interested in owning your own business, you may want to consider what becoming a franchisee has to offer. The benefits are great, and the potential for success is huge!

There are many ways to research the different franchises that are available in the market place. Perhaps the easiest method is to use the internet to identify the different opportunities that are out there. If you use any search emgine and type in 'franchises' or 'franchise opportunities' or 'franchise directories you soon start to build a list of possible franchises that you are interested in. <bio>Mark Harris is a Franchise Director and runs a Franchise Directory http://www.franchiseseeker.co.uk which contains a number of Business Franchises and Franchise Opportunities for people looking to buy a franchise. </bio>

Many franchises run successfully with only minor problems between the franchisee and franchisor. But sometimes disputes can arise. What is the best way to handle these disputes?

Most disputes arise primarily because of lack of communication. It is important to keep lines of communication open at all times so that minor niggles are resolved easily and quickly.

The first point of call is to raise the matter verbally to the franchisor or their representative. Do not make your dispute public or raise any threats at this point. Make sure you raise the matter clearly, politely and in a fair manner.

If this approach fails to yield a satisfactory result then it is time to put your position forward in writing direct to the franchisor. Again try and look at both viewpoints when writing the letter and make sure you send the correspondence by registered post.

In your letter clearly identify what the problem is, the outcome you are seeking and what you hope to achieve. Make sure you keep a copy of this letter.

It can take anywhere between one and three weeks to get a written response depending on how large an organisation you are dealing with. Be patient as the grievance will have to be analysed and if possible solutions created.

If this approach fails then now is the time to write to the franchisor to look at appointing a mediator to analyse the problem and find a solution. How this works will be clearly laid out in your franchise agreement. Usually both parties pay half the cost of the mediator.

The mediator will look at your grievances in an unbiased manner and hopefully help to resolve the dispute in a short and timely manner. Many problems that seemed impossible to resolve have been solved very quickly once a mediator has been appointed.

The mediator's role is often not to dictate the solution but rather try and get the franchisee and franchisor talking so that they can reach an amicable solution. If this approach doesn't work then the mediator might be forced to give their own judgement.

Often the mediator will ask for some payment upfront and an agreement will need to be signed that deals with how the mediation is to be handled and the relative costs of both the parties.

Each party will have to bear their own costs for travel arrangements and accommodation. The time and place of the meetings will have to agreed by the three parties concerned.

Finally if even this approach fails then the only solution left is to seek redress through the courts. This final strategy can be extremely expensive and should only be attempted if the funds are there and the franchisee is sure of his or her case.

If the grievance is not too detrimental to the running of the business then it is perhaps better to give up and resign yourself to the fact that the franchisor has won the argument. Bear in mind that the franchisor invariably tends to have very deep pockets and can drag on the case for a very long time! <bio>Naz Daud is the Founder of CityLocal http://www.citylocal.co.uk http://www.citylocal.co.uk/frontend/franchiseinfo.php?cityid=79 http://www.citylocal.ie http://www.ecademy.com/account.php?id=120141 </bio>
