Some articles may not be quoted or reprinted from unless you also provide a link to the URL of the author's choice. <br /><br /> Crediting an article to its rightful source is called attribution. You must always attribute the work of others and you must do it every time you quote from the article. This is true of direct quotes and paraphrasing. You can't condense someone else's writing and then assume that the readers will know that it belongs to ideas that are quoted earlier on in the article. If you indicate that I am the author (attribution) you aren't really plagiarizing. It isn't hard to be fair with material that is out in the public domain or exists with some fair and reasonable licensing restrictions, such as an <a href="http://www.artwoo.com/tag/attribution" rel="tag">attribution</a> and/or non-commercial license. <br /><br /> To cover attribution, we would send an email and/or place a link back to a and<a href="http://www.artwoo.com/tag/quot" rel="tag">quot</a>;commercially orientedandquot; page on the author's website where they can make money off their own back. <br /><br /> For non-commercial use, we would andquot;payandquot; with a bio/profile webpage and lots of <a href="http://www.artwoo.com/tag/google" rel="tag">google</a>-friendly keywords to drive traffic from our website to the creators' commercially-oriented web site. <br /><br /> Anything beyond that, we aren't interested in, or capable, or willing to cow tow to the <a href="http://www.artwoo.com/tag/copyright+system" rel="tag">copyright system</a>. Copyright, whilst important, has become a <a href="http://www.artwoo.com/tag/web+of+deceit" rel="tag">web of deceit</a> in many cases, and we can't play games, we have the pee to take. <br /><br /> Less seriously, but valid.  Original material we can access on the www without a password should be deemed freely available. We should be allowed to use and reproduce it, as is, without a need to pay up. <br /><br /> Plagiarizing or taking something as our own, without the consent of the copyright holder is different - we arent clever enough to do it ourselves - and we don't condone it either. <br /><br /> Copyright should not be a usable weapon after the fact!  If you don't want a photo to be reproduced on the internet without permission, please publish it <a href="http://www.artwoo.com/tag/behind+closed+doors" rel="tag">behind closed doors</a> or as thumbnails, in the first place. <br /><br /> We say this because most owners of photos never had any commercial use or intentions for photos placed in public galleries. So by definition, no copyright should really exist forbidding an enterprising website owner from simply copying (not altering, or taking it as their own, just copying) that DIY image or creation and placing it on their own website, to use as part of their own material. <br /><br /> Crediting the creator, not themselves, for its existence, would be the correct thing to do in this case, of course. What doesn't strike us as correct is for that DIY-er to claim commercial costs if someone else tries to be creative and in the process makes the DIY-er's snapshot famous. <br /><br /> Fair Use  A copy of a blockbuster movie found on the internet is not original material, so that breaks all copyright law and should not be distributed by anyone - in its entirety. But published snippets should come under Fair use, because those snippets are a crap product, like selling chicken bones without any meat on them. <br /><br /> It shouldn't be a legal requirement either, to pay if you want to post images or video snippets of films or TV shows. That should be deemed Fair Use too of another basically crap, incomplete product. Links back to the copyright holders' full value-for-money offering should be sufficient compensation, especially as highlights tend to wet people's appetites for more of the real thing, creating a new customer for the TV producers. <br /><br /> Unfair world  Of course what should and what does happen are miles apart. People can't be trusted to even post links to MGM, let alone recognise the efforts of some obscure photo-blogger in China. Quit wasting time dwelling on what is negative in your life and concentrate on what is positive. The latest Paypal spoof I received warns me that my <a href="http://www.artwoo.com/tag/paypal+account" rel="tag">Paypal account</a> has been suspended. It asks me to restore full access to my account by logging in to Paypal. When I click on the link provided in the <a href="http://www.artwoo.com/tag/email" rel="tag">email</a>, I am sent to a website that looks exactly like the PayPal login page. But the link does not go to Paypal. <br /><br /> This is the link displayed in the email I received. <br /><br /> <a href="https://www.paypal.com/cgi-bin/webscr?cmd=_login-run" >https://www.paypal.com/cgi-bin/webscr?cmd=_login-run</a> <br /><br /> When you click on the link it actually takes you to a phisers page. <br /><br /> It is generally not a good idea to click on links in an email. If you do, be sure that you are signing into the <a href="http://www.artwoo.com/tag/paypal+website" rel="tag">Paypal website</a> by looking at the address location area of your browser. <br /><br /> If you have already replied to the fraudulent email, contact your bank or credit card companies immediately to prevent identity theft. If you wish to check your Paypal account status, manually type PayPal's address into your browser and log in normally. <br /><br /> I was able to tell that it was a spoof email because the email began with "Dear <a href="http://www.artwoo.com/tag/paypal+member" rel="tag">PayPal member</a>." Paypal will always address you by your first and last name. They will never send you a message and address you as "Dear PayPal member" or such. <br /><br /> Another way to tell if an email is from Paypal is to look at the full header. The email header is your indication of whether the email is from Paypal or not. When looking at the header it should say who sent the email in the first two lines. Example in the latest spoof email I received it came from <br /><br /> Return-Path: lester@server.ravin.net <br /><br /> Received: from <a href="http://server.ravin.net" >http://server.ravin.net</a> <br /><br /> If it doesn't say that it passed through Paypal's server, then you know the email is a spoof. The FBI is actively investigating these spoofs, so please report any suspicious emails by forwarding them to spoof@paypal.com.     <content:encoded><![CDATA[<a href="http://www.artwoo.com/tag/intrinsic+motivation" rel="tag">Intrinsic motivation</a> is when an individual is motivated by internal factors, as opposed to external factors. <br /><br /> Examples of intrinsic motivation would be doing something because you feel it is the moral and ethical thing to do; doing something because you know it will benefit others or doing something because it brings you pleasure and joy. <br /><br /> The latter is common in regards to an enjoyable pastime or a hobby. <br /><br /> It is believed that intrinsic motivation is far stronger than <a href="http://www.artwoo.com/tag/extrinsic+motivation" rel="tag">extrinsic motivation</a> however there are times when extrinsic motivation can become stronger because it displaces intrinsic motivation. <br /><br /> This is known as the overjustification effect. For example this occurs when you begin doing something for intrinsic reasons and then are offered monies or another type of reward for doing it that overrides the reason you started doing it in the first place. <br /><br /> In many cases when this happens, a person loses interest in the activity once the reward is taken away. The key is to not offer large extrinsic rewards for something that is meant to be motivated intrinsically (in other words, from within). <br /><br /> Intrinsic motivation has been widely studied by researchers in the realm of education since the start of the 1970s and their findings have been that when students are intrinsically motivated to do well in school, they tend to <a href="http://www.artwoo.com/tag/perform+better" rel="tag">perform better</a>, make higher marks and they also tend to enjoy the material they are learning a great deal more. <br /><br /> A man named <a href="http://www.artwoo.com/tag/bernard+weiner" rel="tag">Bernard Weiner</a> created a theory known as the andquot;Attribution Theoryandquot; and he looked at such things as the orientation of goals and the <a href="http://www.artwoo.com/tag/locus+of+control" rel="tag">locus of control</a> (internal and external). <br /><br /> As an aside, an <a href="http://www.artwoo.com/tag/internal+locus+of+control" rel="tag">internal locus of control</a> is when a person believes that they have control over what happens to them whereas an <a href="http://www.artwoo.com/tag/external+locus+of+control" rel="tag">external locus of control</a> means that a person believes that control is outside of themselves and has more to do with extraneous factors as opposed to their own actions. <br /><br /> According to Bernard Weiner, students are much more likely to possess intrinsic motivation in their studies if they feel that their educational achievements have more to do with their own efforts as opposed to anything else. <br /><br /> As well students will experience intrinsic motivation if they feel that they play a paramount role in attaining their own personal educational goals as opposed to feeling as those it has more to do with luck or simply a andquot;roll of the dice.andquot; Finally when students have motivation that comes from within they will work harder to completely understand and master a given subject as opposed to simply learning the work at hand so they can pass a test or exam and then forgetting it afterwards. Which brings me to an important question, just how can you keep your child safe online? <br /><br /> The Internet is a "gateway" which leads the adult predator to your child. Parents need to recognize the need to better monitor their children's online activity. I believe that websites like <a href="http://www.artwoo.com/tag/xanga" rel="tag">xanga</a>, <a href="http://www.artwoo.com/tag/myspace" rel="tag">myspace</a>, and <a href="http://www.artwoo.com/tag/livejournal" rel="tag">livejournal</a>, make it all too easy for sexual predators to prey on our children. <br /><br /> Children are vulnerable and they don't realize that anyone can and most likely is reading their blog entries. Both my children have blogs, however they are under moderation by both my husband and I. Frankly, as a parent of two teenagers I believe that it is up to us as parents to educate our children about the online dangers. <br /><br /> Children's blogs are a pedophile's playground, because of the easy ability to look into a child's world. As parents we can help our children stay safe while using a blog. I should have read the privacy policy before I registered. <br /><br /> It reads: hi5 collects personal information when you register, when you use hi5, when you visit hi5 pages or the pages of certain hi5 partners. hi5 may combine information about you that we have with information we obtain from business partners or other companies. Once you register with hi5 and sign in to our services, you are not anonymous to us. hi5 collects information about your transactions with us and with some of our business partners. hi5 automatically receives and records information on our server logs from your browser. <br /><br /> <a href="http://www.artwoo.com/tag/basically" rel="tag">Basically</a>, they have spyware. <br /><br /> Hi5 collects your <a href="http://www.artwoo.com/tag/hotmail" rel="tag">Hotmail</a> or yahoo address lists and contacts. Once you register there is an e-mail that is sent to everyone in your address book. This e-mail is sent without your permission. <br /><br /> The website also requests, your hotmail and yahoo password. I never gave my password, I was not that gullible. However hi5 was still able to gather my information and contact those listed in my address book. I finally was able to delete my account, through the instructions in their help file. <br /><br /> In my opinion, hi5 is even worse than xanga and myspace. <br /><br /> I encourage all parents, whose children have an account on hi5, to log into hi5 and delete their children's account. <br /><br /> Too much personal information is being revealed on these websites, making it a haven for sexual predators. Parents need to wake up. <br /><br /> I for one, am very concerned with websites like hi5, MySpace, Xanga, DeadJournal, Blurty, etc that encourage children to post their photos and personal information. <br /><br /> I strongly suggest that if your child uses the computer and you have not been monitoring their activity, it is time that you found out just what they are doing. <br /><br /> You owe it to your children.   <bio>Rose DesRochers is a published poet and freelance writer. We have a perfect picture in our heads about what life should look like then we go about acting on life to give us whatever it is we think would be perfect. The only problem with this approach is that we are giving away our <a href="http://www.artwoo.com/tag/personal+power" rel="tag">personal power</a>. <br /><br /> Whenever we wait for certain things, people or conditions to be in place in order to be "happy," what do we do in the meantime? I'll be happy when my <a href="http://www.artwoo.com/tag/wife+cooks" rel="tag">wife cooks</a> more often or I'll be happier if my husband were more romantic. Or I'll be happy when my children start listening to what I say and stop sassing me every time I turn around. Or I'd be very happy at work if my boss would just recognize the contributions I make. This is when we want other people to match up to the perfect world we have created in our minds. <br /><br /> Then, there are those situations when we make our happiness contingent on certain things. I'll be happy if I made more <a href="http://www.artwoo.com/tag/money" rel="tag">money</a>. I can't make more money until I finish my degree. I'll be happy when we can have our own home. I'll be happy if I can get a <a href="http://www.artwoo.com/tag/new+job" rel="tag">new job</a>. I'll be happy when my parents are healthy. Again, I ask, "What does one do in the meantime?" <br /><br /> While it is perfectly acceptable to hope for things to be different in your life and to strive to improve and make things better, it's unacceptable to waste your life on <a href="http://www.artwoo.com/tag/negative+emotions" rel="tag">negative emotions</a>. There is a saying that you are what you think about and that what you keep in mind expands. So, if you are always <a href="http://www.artwoo.com/tag/focus" rel="tag">focus</a>ed on the negatives and the things you lack, then you will attract more negative into your. <br /><br /> However, if you focus on the positive and what you have that's good and helpful, then you will attract more positive things into your life. Which would you rather have? Then you must begin to change your thinking. <br /><br /> We have almost <a href="http://www.artwoo.com/tag/total+control" rel="tag">total control</a> over our thinking. I know there are unwelcome thoughts that intrude on our consciousness every day. However, we have the power once they are there to focus our mind elsewhere. All we need is to have a plan in place that whenever I think about X, Y and Z--things I don't want occupying my mind--then, I will think about my summer vacation instead. Focus on any positive experience--past, present or future. <br /><br /> So why do you have to be the one who changes when it is obvious that the "other person" is the one with the problem. I quoted the work of another author in the above <a href="http://www.artwoo.com/tag/paragraph" rel="tag">paragraph</a>, where I defined copyright. Given my example in the opening paragraph, did I just infringe on the author's copyright? Should I have gotten permission from the said author to quote them? No, under what is known as "fair use", I may quote the author without seeking permission. <br /><br /> There is a misconception in the writing world about what fair use is. Fair use is defined as "a concept in copyright law that allows limited use of copyright material without requiring permission from the rights holders, eg, for <a href="http://www.artwoo.com/tag/scholarship" rel="tag">scholarship</a> or review." <br /><br /> If you were to publish an author's article in its full entirety without seeking permission from that author you would be violating their copyright even if you credited the author and provided a link to the source of the article. Some people say use the maximum number of links possible in your <a href="http://www.artwoo.com/tag/author+resource" rel="tag">author resource</a> box. Others say use just one. I think it really depends. <br /><br /> The first rule of thumb with article author resource boxes is to only include information that is relevant to your article. For instance, if you run a <a href="http://www.artwoo.com/tag/dog+kennel" rel="tag">dog kennel</a>, an IRS <a href="http://www.artwoo.com/tag/tax+preparation+service" rel="tag">tax preparation service</a>, and a <a href="http://www.artwoo.com/tag/day+spa" rel="tag">day spa</a> and you write an article about <a href="http://www.artwoo.com/tag/how+to+save+money" rel="tag">how to save money</a> on your taxes then you want to include the fact that you are the owner of an <a href="http://www.artwoo.com/tag/irs+tax" rel="tag">IRS tax</a> preparation service. <br /><br /> You don't want to mention that you own a dog kennel or a day spa. On the other hand, if your article is about how to groom your poodle for show then you would want to mention that you own a dog kennel but you should leave out the IRS tax preparation service and the day spa. <br /><br /> I think the reason for this is obvious. People interested in one service won't necessarily be interested in the other and it could actually ruin your credibility with your <a href="http://www.artwoo.com/tag/target" rel="tag">target</a> audience to mention non-relevant interests. But that tells us nothing about links. <br /><br /> Based on the above principle, of course, you can reason that unrelated links should be left out of your author resource box. Don't link to your dog kennel website in an author resource box attached to an article about the health benefits of a day spa. But what if you own a day spa and a massage parlor, two related businesses? <br /><br /> You could provide a link to both business websites in an article about general health and wellness tips. But should you? I'd say you shouldn't IF the two businesses are separate businesses and not related to each other by legal status. <br /><br /> On the other hand, if you have a business website and a blog that represents the same business entity then you probably do want to include a link to both websites. <br /><br /> The reason is because some people will be threatened by the website, which they know will have a strong sales pitch, but they might be interested in reading what you have to say on your blog because it is viewed as less threatening. <br /><br /> Ultimately, the decision is yours. But the principles that I use in determining how many links should go into my article author resource box are these: <br /><br /> =95 Are the links related to the article content?  =95 Are the links related to each other?  =95 How much space is alloted for the author resource box at the directory or website it is being submitted to?  =95 Which website am I more interested in driving traffic to?  =95 What is my target audience and how will they perceive each link? <br /><br /> These are all important considerations and very important when deciding what links to put into your author resource box. <br /><br /> Generally speaking, though, fewer links is better because people are less likely to click through to any website if they have trouble deciding which link is most attractive.   <bio>Allen Taylor is an Article Marketing Expert. In the case of your music, that author would be you. <br /><br /> This rule about <a href="http://www.artwoo.com/tag/copyright+music" rel="tag">copyright music</a> expiration was first put into place so that the families and heirs of an author could still earn royalties even after his or her death. Ultimately <a href="http://www.artwoo.com/tag/this+means+that" rel="tag">this means that</a> if you've taken the steps to copyright your music and have registered the copyright, then your music will be protected throughout your lifetime until 70 years after you or the last surviving author (assuming a collaboration) is deceased. <br /><br /> Copyright music expiration is not something you should make a primary concern unless you are having issues of someone respecting and/or honoring your copyright at the moment. How can a novice writer protect themselves? <br /><br /> Anyone can call themselves a publisher. Always remember money flows towards the author from the publisher, not the other way round. <br /><br /> What to look out for: <br /><br /> Charges the author a fee up front, to have their book accepted, considered or read. These fees are sometimes called a reading fee, intake fee or administrative fee. <br /><br /> Directs <a href="http://www.artwoo.com/tag/authors" rel="tag">authors</a> toward specific editing services or gives authors' names to these services, with the caveat that if the author hires the editing service, their book will be published. Every book needs editing. It is part of the publisher's job to provide that editing at no cost. <br /><br /> Offers a contract where the author has to pay for part of the publishing costs. The acquisition editor will sometimes say that the publisher's list is full for that season, but the author's book has so much going for it, they would still like to publish it. However the publisher's resources are fully committed and the author will have to share in the costs. <br /><br /> Some publishers offer contracts that are unfair, such as they obtain rights that should remain with the author of the work. <br /><br /> Some publishers' contracts contain a clause that if the author says anything negative about the publisher, there is a monetary fine. <br /><br /> There are also publishers who hold the rights for a lengthy time period, regardless of whether the book is still in print or selling. <br /><br /> The publisher doesn't disclose they are a Publish on Demand (<a href="http://www.artwoo.com/tag/pod" rel="tag">POD</a>), or vanity/<a href="http://www.artwoo.com/tag/subsidy+publisher" rel="tag">subsidy publisher</a>. There is nothing wrong with an author using a subsidy/<a href="http://www.artwoo.com/tag/vanity+publishing" rel="tag">vanity publishing</a> company as long as the author is well aware of the disadvantages. Available is not the same thing as stocked. Available only means the book can be ordered through the bookstore. Since the majority of books sold, are stocked and sold by bookstores, this situation puts a damper on sales. <br /><br /> What else can a writer do to check if a publisher is legitimate? <br /><br /> Go to the local bookstore and see if any of the publisher's titles are stocked. Ask the manager if necessary. <br /><br /> Search the Internet using the publisher's name plus the word 'scam' or 'complaint.' <br /><br /> A publisher's website is targeted to its customers.     <content:encoded><![CDATA[ <a href="http://www.artwoo.com/tag/copyright+infringement" rel="tag">Copyright infringement</a> is not an easy thing to explain. While it may seem as simple as not using someone else's work, it's not that easy. Thanks to the <a href="http://www.artwoo.com/tag/electronic+frontier+foundation" rel="tag">Electronic Frontier Foundation</a>, and many other organizations, we have the ability to use others' works -- as long as we use it under Fair Use laws. So what does Fair Use have to do with copyright infringement, and how can you utilize it? <br /><br /> Fair Use laws allow us to use a copyrighted work without having to pay someone royalties. This includes using a copyrighted work for educational or instructional uses, criticism of the work, commentaries on the work, news reporting about the work, teaching on the work (including multiple copies for classroom use), scholarship uses, and research. This is talked about fully in Section 107 of the <a href="http://www.artwoo.com/tag/copyright+code" rel="tag">Copyright Code</a> (commonly called Fair Use) and is available for you to read at your local library. <br /><br /> Copyright Infringement in day-to-day life <br /><br /> Sometimes, if you're writing a paper for work or school, or if you are creating a <a href="http://www.artwoo.com/tag/power+point+presentation" rel="tag">Power Point presentation</a>, you need to use someone's work that is already in copyright. So how do you use it without committing copyright infringement? All you have to do is ask -- the worst they can say is no, right? But, if they do say no, there are several items in the <a href="http://www.artwoo.com/tag/public+domain" rel="tag">public domain</a> which may help you to finish your project without having to commit copyright infringement. <br /><br /> What is the public domain, and how does it relate to copyright infringement? <br /><br /> Material that is not copyrighted is considered in the public domain. You cannot commit copyright infringement on works in the public domain. These works include things that the copyright has expired on, or is not copyrightable -- such as government publications, jokes, titles, and ideas. Some creators (writers, musicians, artists, and more) deliberately put their work in the public domain, without ever <a href="http://www.artwoo.com/tag/obtaining+copyright" rel="tag">obtaining copyright</a>, by providing an affiliation with <a href="http://www.artwoo.com/tag/creative+commons" rel="tag">Creative Commons</a>. Creative Commons allows people who create materials to forfeit some, or all, of their copyright rights and place their work either partially or fully in the public domain. <br /><br /> So, how do I ensure I'm not committing copyright infringement? <br /><br /> First of all, if you're going to use someone else's material, you may want to check the public domain to see if something is suitable for use, instead of trying to use someone else's copyright. However, if you can't find something suitable (and you can't create something yourself), the next best thing (and your only legal course of action) is to find a piece that is in copyright, and contacting the copyright holder. <br /><br /> When you contact the copyright holder, make sure you tell them what you want to use their piece for -- whether it's for your blog, podcast, or report -- and ask if you can use it. You may have to pay royalties, or an attribution in your piece, or a combination of both. The creator may also place many limitations on when and how you can use their material. Follow all these instructions they give you, and you'll be free and clear to use their work as you want. <br /><br /> Once you have permission to use a copyrighted work, you need to make sure you stay within the agreed-upon boundaries. If you veer outside their agreed terms, you may open yourself up for a copyright infringement lawsuit, which can be nasty, costly, and time consuming. If you're in doubt, before contacting the copyright holder, contact a copyright lawyer to ensure you're following the law -- and protect yourself! <br /><br /> QUESTION: If you hear a great new band, and then download a song from MySpace, is that legal or not? <br /><br /> ANSWER: The events of copyright infringement are not only limited by Kazaa, Morpheus, or some other file sharing peer to peer (P2P) service. If you download a song -- no matter if you're on a website or a MySpace page -- and it isn't coming from the artist themselves, you may want to think about downloading it. Chances are, if it's not coming from them, you can't have it -- unless it is under a Creative Commons License. Creative Commons gives the exact ways in which you can use the license -- and many times those are completely free and legal to download, so make sure you check if it's under a CC License.<br /><br /><br /><br /> QUESTION: If I'm writing a paper, or article, and I want to quote another website, can I? <br /><br /> ANSWER: First of all, did you know the minute you write or create something, you hold the copyright to it? ESPECIALLY if you're writing it online -- it's very easy to track things on the Internet. So, if you're writing a blog, all the things you've written (no matter good or bad) are recorded, thanks to Archive.org, which lets you review last versions of your web pages. <br /><br /> Sometimes, we can use someone else's work in our own, and think we're small and anonymous. That no one will notice by the time you get it down -- you're just "borrowing" it. Before you begin quoting anyone's website -- from CNN to your local neighborhood hardware store -- you need to ask the person who holds the copyright if you can. Usually, they'll let you if you attribute to them. Depending who you talk to, you'll either have to pay royalties or license rights to republish. Knowing exactly what <a href="http://www.artwoo.com/tag/copyright+infringement" rel="tag">copyright infringement</a> is, whether you're creating an eBook, publishing articles, using music as a backtrack to your podcast, is important. Although copyright laws change from one jurisdiction to another, knowing the basic rules of copyright infringement will ensure you're following the proper <a href="http://www.artwoo.com/tag/rules+of+engagement" rel="tag">rules of engagement</a> when you create your works. Before you make any final decisions regarding the use of a work that has been copyrighted, always <a href="http://www.artwoo.com/tag/contact" rel="tag">contact</a> a copyright attorney to ensure you're following the law -- this will keep you from being sued or, even worse, punished in a court of law. <br /><br /> What is Copyright Infringement? <br /><br /> Copyright infringement, as defined by <a href="http://www.artwoo.com/tag/wikipedia" rel="tag">Wikipedia</a>.org, states: "Copyright infringement (or copyright violation) is the unauthorized use of material that is protected by <a href="http://www.artwoo.com/tag/intellectual+property+rights" rel="tag">intellectual property rights</a> law particularly the copyright in a manner that violates one of the original copyright owner's exclusive rights, such as the right to reproduce or perform the copyrighted work, or to make derivative works that build upon it. The slang term bootleg (derived from the use of the shank of a boot for the purposes of smuggling) is often used to describe illicitly copied material." <br /><br /> So, what is copyright infringement in plain English? It means if you're not allowed to use something, then don't use it -- plain and simple. It can be very simple to get permission to use a work -- many times you'll be able to use a "sample" of music or an excerpt of writing for a nominal fee, or a small attribution. However, if you do not have the permission of the copyright holder -- whether it's an author or a publishing house -- you can be sued for copyright infringement or worse. <br /><br /> What is Copyright Infringement in America? <br /><br /> In many jurisdictions, such as the United States of America, this act is known as a <a href="http://www.artwoo.com/tag/strict+liability" rel="tag">strict liability</a> crime or tort (a tort is a civil wrong -- not a criminal wrong). This means the person who infringes the copyright -- whether intentionally or not - will be responsible for the damage or loss. Also, the prosecutor (in criminal court) or plaintiff (in civil court) must only prove that the act of copying was committed by the defendant -- they do not need to prove guilty intent. This means, even if you had no intention of committing copyright fraud or infringement, you can (and in present times, in many cases, WILL) be prosecuted, even if you used the material in good faith. <br /><br /> What is Copyright Infringement in Action? <br /><br /> Many cases of copyright infringement are difficult to see to the layperson, because the violation is not limited to exact copying. In many cases, when something is inspired by another thing -- such as in music, when the inspiration of one song is used to create an entirely different song -- it's difficult to see where the new product or "thing" has crossed the line to something illegal. Some works aren't even protected by copyright, such as compilation of facts that lack the creativity necessary to be covered by copyright, or works that are in the public domain because the copyright has expired. Knowing the difference is often very difficult to see, and because of this we've seen a number of copyright infringement cases in recent years, especially in tandem with the music industry. <br /><br /> As you can see, copyright infringement is a very difficult, albeit necessary, act to define. However, if you make sure you're using works that are in the public domain, or have long since been out of copyright (think Beethoven or Frankenstein), you'll be safe. Do your fair share of research. This is largely due to online services that allow unchecked file sharing among their subscribers. While this abuse of copyright is not only limited to music, this is where we observe the most profound effects of file sharing. <br /><br /> Industry giants of file sharing are emerging quickly with the demise of the pioneer for illicit file sharing, Napster. The Recording Industry Association of America (or RIAA) has made copyright music infringement their primary focus. They estimate that peer-to-peer file sharing steals 4.2 billion dollars worldwide each year from the coffers of the music industry. These estimates, however, assume people would buy every piece of music they downloaded. <br /><br /> The RIAA has argued that new and struggling bands are less likely to continue making music because it will no longer be profitable. The bulk of musicians' incomes result in royalties, which depend entirely on the sales of their albums. <br /><br /> The RIAA also argues that people burning music to CDs (which they have bought) does not constitute fair use because CDs are not "unusually subject to damage"; if they do become damaged they can be replaced affordably. This assertion has raised more than a few eyebrows and is giving rise to opponents of the RIAA who claim the lawsuits and crackdowns against those presumed guilty of copyright music infringement are actually hurting music sales and the profits of the music industry. <br /><br /> During the height of Napster popularity (the hallmark by which all file sharing seems to be compared) CD sales were at their highest rate ever. People were exposed to music and music groups which they otherwise may not have heard without file sharing. As a result of enjoying the music by these music groups, people bought the CDs of the music they enjoyed. It's ironic that the very lawsuits designed to stop copyright music infringement have actually managed to stifle file sharing enough that CD sales are dropping noticeably around the world. <br /><br /> Opponents and critics also challenge that rather than being a source of copyright music infringement, peer 2 peer networks offer unprecedented exposure for new artists and their music. Another argument against the RIAA is that the reason for the lawsuits against file sharers is because they want to keep the prices for CDs over inflated while keeping the actual royalties coming to the artists relatively low. The copyright music infringement claims made by the RIAA have become suspect. <br /><br /> The music industry is currently working on ways where fans can legally download music. This will mean that music fans have access to the music they love from their PCs and directly to their music playing devices without resorting to illegal copyright music infringement.
