    <content:encoded><![CDATA[Commonly there is an expectation amongst <a href="http://www.artwoo.com/tag/parents" rel="tag">parents</a> of children in close knit families, particularly when a family is of humble means, that the children will grow up, gain a good education and be successful. Taking this one step further those parents of Australian citizens or <a href="http://www.artwoo.com/tag/australian+permanent+resident" rel="tag">Australian permanent resident</a>s expect to be able to join their children in Australia as permanent residence and eventually as Australian citizens. <br /><br /> <a href="http://www.artwoo.com/tag/australian+migration" rel="tag">Australian Migration</a> Laws however do not allow parents of every Australian permanent resident or every foreign born Australian citizen to <a href="http://www.artwoo.com/tag/migrate+to+australia" rel="tag">migrate to Australia</a> as a permanent resident. There are a number of conditions that the parents have to fulfil or gateways that they successfully have to negotiate to migrate to Australia. Some of the more important ones are discussed below.  Balance of Family Test <br /><br /> The andquot;balance of familyandquot; test is defined in Regulation 1.05 of the Australian <a href="http://www.artwoo.com/tag/migration+regulations" rel="tag">Migration Regulations</a>. Briefly, to pass this test a parent must have at least half of his or her children permanently residing in Australia (including eligible New Zealand citizens i.e. children with subclass 444 visas) OR  they must have the greatest number of children permanently residing in Australia than in any other single overseas country. By way of an example, a parent who has 5 children and 3 of them live in country A and 2 of them <a href="http://www.artwoo.com/tag/live+in+australia" rel="tag">live in Australia</a>, that parent would not satisfy the balance of family test.  However if the same parent has 1 child in country A, another child in country B and third child in country C and 2 children in Australia, that parent would satisfy the balance of family test. Further if the parent had 3 children in Australia and 2 in other countries then the balance of family test will be satisfied. If the parent had 4 children and 2 were permanently resident in Australia, the balance of family test would be satisfied. <br /><br /> A person is considered the child of a parent if the person is a child, adopted child or stepchild of the parent or of the spouse of the parent. A child can also be the child of a parent if the child is the child of a former spouse of the parent if that child was adopted by the parent before the parent became the former spouse i.e. while the parent was the spouse of the former spouse. <br /><br /> In assessing children for the balance of family test the following children are not to be considered the children of the parent: <br /><br /> - children who have been adopted by another person; <br /><br /> - a child who has been ordered by a Court to be removed from the exclusive custody of the parent; <br /><br /> - children who have been recognised by UNHCR as refugees and are in a refugee camp; <br /><br /> - children who are not able to be reunited in another country with their parents and who are resident in a country where they are subject of persecution and abuse of human rights; <br /><br /> - step children of a person if those children were born after their parent and a step parent separated; <br /><br /> - step children of a person if the children were over 18 years of age and their parent entered into a relationship with the step parent and relationship between the parent and the step parent has ended by death, separation or divorce. <br /><br /> Unless the andquot;balance of familyandquot; test is satisfied, there is no flexibility in succeeding in an application for an Australian permanent resident visa on the basis of being a parent of an Australian citizen, permanent resident or eligible New Zealand citizen.  <bio>Frank Egan is the Chief Executive Officer of LAC Lawyers Sydney <a href="http://www.laclawyers.com.au" >http://www.laclawyers.com.au</a> and has over 27 years of experience as a lawyer. </bio>]]></content:encoded>

For people who were not born in the United States, there are other ways to become a citizen. For example, becoming a U.S. citizen is almost automatic if at least one of a person's parents was born in the U.S., and the person has lived here for the minimum period of time specified by federal law. Otherwise, people can become U.S. citizens through a process called naturalization.<br><br>The processes of <a href="http://www.artwoo.com/tag/immigration+and+naturalization" rel="tag">immigration and naturalization</a> are regulated by the U.S. <a href="http://www.artwoo.com/tag/citizenship+and+immigration+services" rel="tag"><a href="http://www.artwoo.com/tag/citizenship+and+immigration" rel="tag">Citizenship and Immigration</a> Services</a> (USCIS), which is part of the Department of Homeland Security. The exceptions apply to a person who:<br><br>• Is 55 years old and has been a permanent resident for at least 15 years; or<br>• Is 50 years old and has been a permanent resident for at least 20 years; or<br>• Has a physical or mental impairment that makes him or her unable to fulfill these requirements.<br><br>Naturalization can be a long and arduous process, often taking years to complete. Generally, in order to apply for naturalization, a person applying for naturaliztion must be:<br><br>• At least 18 years of age and have been a permanent resident of the U.S. for at least 5 years; or<br>• At least 18 years of age and have been a permanent resident of the U.S. for at least 3 years; during which time you have been, and continue to be, married to and living in marriage with your husband or wife, who is a United Stated citizen; or<br>• Have served honorably served in the U.S. military.<br><br>In addition, some spouses of U.S. citizens and some members of the military may be able to file for naturalization sooner than the times listed above. To apply for naturalization, a person must file a Form N-400, "Application for Naturalization." Throughout the naturalization process, an applicant has the right to be represented by an attorney, who can fight for the application. This is important because an application for naturalization may be granted, denied or continued. For offshore applicants the first instalment is currently $1,305.00.<br /><br />The second instalment of the visa application charges is $1,135.00 for each applicant for a non-contributory visa and for contributory visas is $16,710.00 for temporary <a href="http://www.artwoo.com/tag/visa+applicants" rel="tag">visa applicants</a> and $27,850.00 for <a href="http://www.artwoo.com/tag/permanent+visa" rel="tag">permanent visa</a> applicants and $1,205.00 for applicants under 18 years. These charges generally are adjusted every 6 months and need to be checked before any planning or commitment is made. <br /><br /> Assurances of Support <br /><br /> The assurance of support for contributory parent visas is $10,000.00 for the main applicant and $4,000.00 for secondary applicants whereas in the non-contributory parent visa applications, the assurance of support is $3,500.00 for the main applicant and $1,500.00 for every adult secondary applicant. <br /><br /> Other Conditions <br /><br /> Other conditions that the applicants have to satisfy are set out in Schedules 1 and 2 of the Migration Regulations and advice needs to be obtained in relation to the circumstances of each separate parent. <br /><br /> Quotas <br /><br /> In the non-contributory category parent visas, in 2003/2004, the quota was 1,500 places and in subsequent years the quota is 1,000 places per year. <br /><br /> In the contributory parent visa category the quota for 2003/2004 was 5,500 places and in subsequent years quota is 3,500. <br /><br /> The Department of Immigration and Multicultural and Indigenous Affairs informs all applicants for parent visas in writing when they have been placed in a queue. Further parents who have a majority of their children living permanently in Australia have a processing priority over parents who do not. However, each case is treated on its own set of facts and the case officers can exercise a great deal of discretion. <br /><br /> Visa Processing Times <br /><br /> For the non contributory parent visas there is a queue of over 10,000 people and therefore any visa applications lodged now may take an extended period of time to process depending on your particular case. For contributory parent visas, the processing time if all documents are in order is about 11 months. <br /><br /> Conclusion <br /><br /> Thus there exists a dilemma for parents wishing to migrate to Australia do they wish to pay the higher second instalment visa application charges and assurances of support for contributory parent visas as opposed to the non-contributory parent visas. Of course there is the permanent employee or the casual or part-time or permanent part-time or even the independent subcontractor. The real difference between the various categories of employment is whether there is a contract of service or a contract for services. <br /><br /> Employment arises in a number of contexts particularly given the social diversity of our workforce today. Due to job sharing, permanent part-<a href="http://www.artwoo.com/tag/time+employees" rel="tag">time employees</a> are becoming more and more acceptable in the <a href="http://www.artwoo.com/tag/australian+workforce" rel="tag">Australian workforce</a>. Of course the predominant type of employee is the full time permanent employee on which the majority of businesses throughout Australia rely. This may have something to do with the fact that 75% of all business transacted throughout Australian is carried out by small to medium enterprises. <br /><br /> Essentially the type of employee that you are is normally set out in a <a href="http://www.artwoo.com/tag/letter+of+appointment" rel="tag">letter of appointment</a>, a contract of employment, an award or other industrial instrument including Certified Agreements or Australian Workplace Agreements or as otherwise agreed with the employer. Irrespective of the documents evidencing employment, employees are often issued with <a href="http://www.artwoo.com/tag/job+descriptions" rel="tag">job descriptions</a> or specifications covering the type of work they are required to carry out. It is becoming more prevalent for employees to be issued with <a href="http://www.artwoo.com/tag/letters+of+appointment" rel="tag">letters of appointment</a> and/or contracts of employment given the deregulation of the Australian workplace. <br /><br /> Often, employees other than full time employees work fewer hours, although with casuals this may not <a href="http://www.artwoo.com/tag/necessarily" rel="tag">necessarily</a> be so.  Sometimes there is confusion as to whether casuals and part-time employees are one and the same. The essential difference between the two is that with part-time employees there is the pre-arranged regularity of the hours of work. In other words, part-time employees work on a regular and systematic basis whereas with casuals there is a certain informality, uncertainty and irregularity of engagement. It should be pointed out that where casual employment is becoming regular and systematic it may be deemed that the person has become a permanent part-time employee, particularly where they have the expectation of ongoing employment. <br /><br /> One of the most telling differences is that a part-time employee is generally entitled to exactly the same benefits and entitlements as a full time employee except on a pro-rata basis.<br /><br />Their pay includes sick leave and annual leave and their pay rates are not as high as casual employees. One of the best ways to distinguish a casual employee from a permanent part-time employee is to look at the appropriate award or  industrial instrument to determine whether they fall within the definition of casual employee. In some cases the employer may have mistakenly described their type of employment as they may not be fully conversant with the legal distinctions between these two classes of employee. <br /><br /> It is always worthwhile to check the award or industrial instrument governing the type of employment and this applies equally to other categories of employee. It is extremely important to remember that normally casual employees have no guarantee of work beyond their current hiring which could be for one hour, several hours, one or more days or a week. Note that with casual employees there is usually a loading built into the rate of pay for casuals to compensate for the lack of permanent employment benefits. The services of a casual employee can be terminated at any time without notice by either party. <br /><br /> Under the NSW Industrial Relations Act and the Federal Workplace Relations Act there is no protection given to casual employees as they belong to one of the classes which is expressly excluded from the unfair dismissal regime set out in those acts. Casual rates of pay are normally 20% higher than standard rates. Remember with casual employees the work is normally irregular, may involve working on different days of the week, is on an on-call basis, wages are paid following each engagement, loadings are paid to compensate for not being a permanent employee and they may refuse to work for the period specified. <br /><br /> Where the work of a casual employee becomes regular and systematic such that they work the same numbers of hours per week prescribed for permanent employees, then, under many awards where they work for at least one month or in the case of metal industry workers, where they work for at least 6 months in this way, then they may become permanent employees. Irrespective if they have been employed by the same employer on this basis for an extended period of time they will have a right to long service leave. <br /><br /> Employee or Independent Contractor <br /><br /> Not all people who perform work are employees as some are independent contractors frequently called independent sub-contractors. The major difference between an employee and an independent contractor is that the former receives a salary or wages for services rendered whilst an independent contractor is a person who carries on trade or business themselves. The employee provides services under a contract of service and the independent contractor under a contract for services. The concept of control is essential to determining when a person falls into one category or the other. In some cases the law construes a person as being a deemed employee which has certain consequences for such individuals e.g. in the areas of workers compensation and taxation.<br /><br />Graphic design and advertising agencies are cases in point as much of the work that they have is subcontracted to other persons to undertake. Spend quality time alone with each dog, to bond with the newcomer, and also to make sure that the older pooch does not feel as if they are being replaced by the 'outsider'. Applicants are given 1 of 250 four-year merit-based scholarships. The applicant must submit his application from September up to the last day of October in his last year in high school. The person should not be a high school graduate before he/she applies. <br /><br />  Requirements <br /><br /> To become a Coca-Cola scholar, you must be: <br /><br /> A U.S. National; U.S. Citizen; Temporary Resident; U.S. Permanent Resident; Asylee; Refugee; Humanitarian Parolee; or Cuban-Haitian Entrant; <br /><br /> Presently enrolled as a high school senior and anticipates to graduate at the end of the school year during the same academic year when he or she made his or her application; <br /><br /> Has a minimum of 3.00 GPA at the end of the junior year in high school; <br /><br /> Has a plan to pursue degree from an accredited U.S. college institution ; <br /><br /> A Coca-Cola scholar must not be grandchildren or children of officers, owners or employees of The Coca-Cola Company, Coca-Cola bottling companies, or other Company subsidiaries or divisions. <br /><br />  Submitting Application <br /><br /> High school senior can apply his or her application during between September 1 and October 31. He or she can apply online. <br /><br />  Scholarship worth <br /><br /> Each year, Coca-Cola awards 250 senior students with a merit-based scholarship. 200 of these are awarded with 4-year $4,000 scholarships ($1,000/yr for 4 years).
